BY-LAW 86-36
being a by-law to authorize the execution
of Supplementary Agreement 115 with Ontario
Hydro (Advancement of Facilities and Services
for Y.W.C.A.Recreational Activities)
THE COUNCIL OF THE CORPORATION OF THE TOWN OF NEWCASTLE HEREBY
ENACTS AS FOLLOWS:
THAT the Mayor and Clerk are hereby authorized to execute, on
behalf of the Corporation of the Town of Newcastle, and seal
with the Corporation's Seal, Supplementary Agreement #15,
between Ontario Hydro and the said Corporation, in respect of
Advancement of Facilities and Services for Y.W.C.A. Recreational
Activities, a copy of which is attached as Schedule IIX.II
By-law read a first and second time this 10th day of March 1986
By-law read a third time and finally passed this 10th day of
March 1986.

SUPPLEMENTARY AGREEMENT NO. 15
ADVANCEMENT OF FACILITIES AUD SERVICES
FOR Y.W.C.A. RECREATIONAL ACTIVITIES
THIS AGREEMENT made in triplicate this 12th day of June, 1986.
BETWEEN:
ONTARIO HYDRO
Hereinafter referred to as the "Corporation"
OF THE FIRST PART
- and -
THE CORPORATION OF THE TO~VN OF NEWCASTLE
Hereinafter referred to as the "Town"
OF THE SECOND PART
- and -
THE REGIONAL MUNICIPALITY OF DURHAM
Hereinafter referred to as the "Region"
OF THE THIRD PART
Whereas the Corporation and Town have entered into an Agreement
(hereinafter referred to as the Newcastle Agreement), with respect

construction and operation of the Darlington Generating Station
(hereinafter referred to as the Station) on the Town dated
March 22, 1977;

AND WHEREAS the Corporation, the Town and the Region have
entered into an Agreement (hereinafter referred to as the
Regional Agreement) with respect to the social economic and
financial impacts arising out of the construction and operation
of the Station on the Region and the Town, dated August 8, 1977;
AND WHEREAS the Newcastle Agreement and the Regional Agreement
provide for the entering into supplementary agreements between
the Corporation, the Town and the Region;
N~D WHEREAS the Corporation, the Town and the Region have
entered into a Supplementary Agreement entitled Community Impact
Monitoring Program which involves collecting and updating data
on certain impact items which may be affected by the construction
and operation of the Station;
AND WHEREAS the Newcastle Agreement provides that the Corporation
agrees to compensate the Town for those financial impacts
undergone by the Town as a result of the construction of the
Station which include the cost of advancing community facilities
and providing such community services as recreational activities;

AND WHEREAS data has been collected regarding impacts on
recreational activities provided by the Oshawa Y.W.C.A. in the
Town of Newcastle and all parties have agreed upon an assessment

of the increase in demand placed upon these recreational

facilities and services by the growing inflow of Darlington
construction workers end their families, it is deemed necessary
to advance funds to improve Oshawa Y.W.C.A. programs and services
in the Town of Newcastle in 1986.
NOW, THEREFORE, WITNESSETH that in consideration of the covenants
hereinafter contained and for other good and valuable consideration,
the Corporation, the Town and the Region hereby agree as follows:
1. The Corporation agrees to pay the Town from Station Account
"B" the sum of $5,000 to improve recreational services
provided by the Oshawa Y.W.C.A. in the Town of Newcastle
in 1986. Payment of said funds will by made to the Town
upon submission of an invoice to the Corporation.
2. The Oshawa Y.W.C.A. agrees that no further requests will be
made for impact funding for program or facility improvements.
The recitals mentioned in this Agreement form part of this
Agreement.
IN WITNESS WHEREOF the Corporation, the Town and the Region
have caused this Agreement to be executed by the ~tfixing of
