THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 86- 2
being a By-law to amend By-law 84-63, Comprehensive Zoning By-law
of the Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend By-law 84-63, as amended, to authorized the
temporary use of land, buildings or structures pursuant to Section 38
of the Planning Act, 1983;
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of
the Town of Newcastle enacts as follows:
1. Section 9.3 IISpecial Exceptions - Residential Hamlet (RH)
Zonell of By-law 84-63 is hereby amended by adding the following new
Subsection 9.3.11:
"9.3.11 RESIDENTIAL HAMLET EXCEPTION (RH-11) ZONE
Notwithstanding Section 9.1, those lands zoned "RH-1111 on the
Schedules to this By-law may, in addition to the other uses
permitted in the IIResidential Hamlet (RH)II zone, be used for a
private kennel. Pursuant to the requirements of Section 38 of
the Planning Act, 1983, a private kennel may be permitted for a
period of three (3) years ending January 13, 1989. The
placement of buildings and structures shall be subject to the
zone requlations set out in Section 6.3c.1I
2. Schedule 12 to By-law 84-63, as amended, is hereby further
amended by changing the zone designation from "Residential Hamlet
-Holding II(H)RH" to Residential Hamlet Exception (RH-11)1I zone as
shown on the attached Schedul e IIX" hereto.
3. This By-law shall come into effect on the date of passing
hereof, subject to the provisions of Section 34 of the Planning Act,
1 983 .
