HomeMy WebLinkAbout86-120 THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW 86- 120 being a by-law to stop-up and close and to authorize the sale of the northerly 5.186 metres of Queen Street, between liberty Street and Lambert Street, in the former Town of Bowmanville, now in the Town of Newcastle, designated as Part 7 on Reference Plan 10R-2267 (A & P Stores) WHEREAS the Council of the Corporation of the Town of Newcastle deems it adviseable to pass this by-law; AND WHEREAS Notice of Intention of the Council of the Corporation of the Town of Newcastle to pass the said by-law in accordance with the requirements of Section 301, Chapter 302, of The Munidipal Act, R.S.O. 1980, was published in the Canadian Statesman on August 13th, August 20th, August 27th, and September 3rd 1986; AND WHEREAS Notice of Intention of Council to pass this by-law was sent by Registered Mail to the Regional Municipality of Durham, on the 71hc day of August 1986, and the Regional Municipality of Durham granted approval to the proposed by-law by letter dated the 3rd day of September 1986. NOW THEREFORE BE IT ENACTED AND IT IS HEREBY ENACTED AS A BY-LAW OF THE CORPORATION OF THE TOWN OF NEWCASTLE AS FOLLOWS: 1. The northerly 5.186 metres of the Queen Street Road Allowance lying between Liberty Street and Lambert Street, in the former Town of Bowmanville, now in the Town of Newcastle, hereinafter described, is hereby stopped-up and closed; ALL AND SINGULAR THAT certain parcel or tract of land, lying and being in the Town of Newcastle, in the Regional Municipality of Durham, Province of Ontario, and being composed of the northerly 5.186 metres of opened Queen Street, at Liberty Street and 5.182 metres at Lambert Street, easterly from the east side of the Liberty Street Road Allowance for a distance of 77.206 metres as measured along the north side of the Queen Street Road Allowance to the west side of the Lambert Street Road Allowance, and 76.986 metres as measured from a point 5.186 metres south of the north edge of Liberty Street to the west side of the Lambert Street Roa~ Allowance, in the former Town of Bowmanville, more particularly designated as Part Seven (7) on Plan 10R-2267, deposited in the Land Registry Office for the Registry Division of Newcastle (No. 10), on July 7th 1986. 2. ALL THAT portion of the open road allowance hereinbefore described as Part Seven (7) on Reference Plan 10R-2267 shall be conveyed by the Corporation of the Town of Newcastle to the abutting owners. Road Allowance for a distance of 77.206 metres as measured along the north side of the Queen Street Road Allowance to the west side of the Lambert Street Road Allowance, and 76.986 metres as measured from a point 5.186 metres south of the north edge of Liberty Street to the west side of the Lambert Street Road Allowance, in the former Town of Bowmanville, more particularly designated as Part Seven (7) on Plan 10R-2267, deposited in the Land Registry Office for the Registry Division of Newcastle (No. 10), on July 7th 1986. 2.
