THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON BY-LAW 94- 173 Being a By-law to restrict the weight of vehicles passing over specific bridges within the Municipality of Clarington WHEREAS subsection 104 b(2) of the Highway Traffic Act (R.S.O. 1980, c.198 as amended) provides that: "The municipal corporation or other authority having jurisdiction over a bridge may be by-law approved by the Ministry limiting the gross weight of any vehicle or any class thereof passing over such bridge, and the requirements of subsection ( 1 ) wi th respect to the posting of notice apply thereto." NOW THEREFORE the Council of The Corporation of The Municipality of Clarington deems it expedient to limit the weight of vehicles passing over specific bridges and enacts as follows: 1. No vehicle or combination of vehicles or any class thereof, whether empty or loaded, shall be operated over the bridge on the highway set out in Column 1 at the location set out in Column 2 of Schedule "I" to the By-law where: a) in the case of a single vehicle, or where the same maximum gross weight applies to single and combination vehicles, the gross weight exceeds the number of tonnes set out in Column 3 (a)i b) in the case of a combination of two (2) vehicles, the gross weight exceeds the number of tonnes set out in Column 3 (b)i and c) in the case of a combination of three (3) vehicles, the gross weight exceeds the number of tonnes set out in Column 3 (c) of Schedule "I" to this By-law. 2. Any person violating the provisions of this By-law shall be subject to the penalties provided in Section 106 of the Highway Traffic Act. 3. This By-law shall not become effective until notice of the limit of weight permitted in compliance with the regulations under the Highway Traffic Act has been posted in a conspicuous place at each end of the bridge, and until approved by the Ministry of Transportation. The approved weight ( s) set out in Schedule "I" will remain in effect for a period of time specified by the Ministry of Transportation.
