HomeMy WebLinkAbout94-160 THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON BY-LAW 94-160 being a by-law to authorize the sale of that portion of the closed road allowance described as being part of Clarke Street (lying between Blocks 'K' and '0') according to C.G. Hanning's Plan, Municipality of Clarington, Regional Municipality of Durham, designated as Parts 1,2 and 3, Plan 40R15760 WHEREAS the Council of the Corporation of the Municipality deems it desirable to pass this by-law AND WHEREAS By-law 89-63 was passed on the 10th day of April, 1989, to stop up, close and to authorize the sale of that portion of the unopened road allowance being formerly parts of Lot 27, Broken Front Concession and that portion of Clarke Street between Blocks 'K' and '0', Hanning's Plan, Village of Newcastle, Town of Newcastle, designated as Part 2, Plan 10R3009 AND WHEREAS By-law 90-148 was passed on the 10th day of September 1990, to amend By-law 89-63 by deleting all reference to "Conveyance" of the lands closed by By-law 89-63 AND WHEREAS Council approved the recommendations in Report WD-47-93 and established the selling price of the closed road allowance at $24, 500. plus costs AND WHEREAS notice of the Council of the Municipality of Clarington to pass said by-law in accordance with the requirements of the Municipal Act, R.S.O. 1990 was published in the Canadian Statesman and the Newcastle Independent on September 7, 14, 21 and 28, 1994 AND WHEREAS notice of the intention of Council to pass this by-law was sent by Registered Mail to the Regional Municipality of Durham on the 7th day of September, 1994, and the Regional Municipality of Durham granted approval to the proposed by-law by letter dated the 4th day of October, 1994 NOW THEREFORE BE IT ENACTED AND IT IS HEREBY ENACTED as a by-law of the Corporation of the Municipality of Clarington that Parts 1, 2, and 3, Plan 40R15760 be conveyed at the established selling price of $24,500. plus costs to the abutting property owners as follows: 1. Parts 1 and 2, Plan 40R15760 be conveyed to Paul and Lisa Halminen 2. Part 3 be conveyed to 562318 Ontario Limited c/o Aldo Firmani By-law read a first and second time this 11th day of October, 1994.
