BY-LAW t 94-131
Being a By-Law to authorize the establishment
of a formal downsizing/restructuring programme
WHEREAS by By-Law #94-130, the Corporation of the Municipality of
Clarington considers it desirable to establish a downsizing
programme as a result of financial constraints, which aims to
reduce its financial obligations by reducing the number of
employees;
ARD WHEREAS the Corporation of the Municipality of Clarington,
pursuant to the Supplementary Benefits provisions of the Regulation
made under the Ontario Municipal Employees Retirement System Act,
R.S.O. 1990, c. 0.29, as amended, has elected to enter into an
agreement with the Ontario Municipal Employees Retirement Board for
the payment of Supplementary Downsizing Benefits;
ARD WHEREAS as a part of the above agreement, qualifying employees
will be offered an early retirement option. The downsizing
programme will therefore entail a review of the Municipal
organization chart subsequent to when it is known which employees
have accepted the early retirement package. At least one position
will not be subsequently refilled as a result of a reorganization
of job functions in some departments;
IT IS HEREBY ENACTED that:
1. The Chief Administrative Officer and the Treasurer are
hereby authorized to establish a downsizing and
restructuring programme within the context of the OMERS
early retirement supplementary downsizing benefits
agreement.
2. This By-law shall come into force on the day of its
passing.
By-Law read a first and second time this 18th day of July, 1994.
By-Law read a third time and finally passed this 18th day of
July, 1994.
