HomeMy WebLinkAbout94-100 THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON BY-LAW 94-100 Being a by-law to authorize the execution of an agreement between The Corporation of the Municipality of Clarington and Mr. Thomas L. Bryson and Mrs. Susan E. Bryson for the purchase of certain lands required for the construction of sidewalks in the Municipality of C1arington. WHEREAS the Municipal Act, R.S.O. 1990, c.M.45, s.191 (1), states that: "The Council of every corporation may pass by-laws for acquiring or expropriating any land required for the purposes of the Corporation ..."; and WHEREAS The Corporation of the Municipality of C1arington requires certain land for the construction of sidewalks. NOW THEREFORE BE IT ENACTED AND IT IS HEREBY ENACTED AS A BY- LAW OF THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON AS FOLLOWS: l. THAT the Mayor and Clerk be authorized to execute on behalf of The Corporation of the Municipality of Clarington, and seal with the Corporate Seal, an Agreement to Purchase from Mr. Thomas L. Bryson and Mrs. Susan E. Bryson attached hereto as Schedule "A" and forming part of this By-law, that portion of Part Lot 33, Concession 2, Former Township of Darlington. BY-LAW read a first and second time this 27thday of June 1994. BY-LAW read a third time and finally passed this 27th day of June 1994. BOX 396, COBOURG ONTARIO, CANADA K9A 4L7 (416) 372-2721 FAX (416) 372-3621 Re: Proposed Sidewalk, East Side of Prestonvale Road, (I-Iwy. 2 to Phair Avenue), Courtice, Town of Newcastle In conjunction with the above noted project, the Town of Newcastle will be extending the existing sidewalk on Prestonvale Road across your lot frontage to Phair Avenue. In order to avoid conflict between the proposed sidewalk and the hydro pole in the southeast quadrant of the intersection of Prestonvale Road and Phair Avenue, the Town wishes to purchase from you a 2.0 metre triangle of property. The location of the required property and proposed sidewalk is shown on the attached plan. As was discussed with you on site, the existing tree adjacent to the work will not be disturbed. The Bell Canada and Cable T.V. pedestals are to be relocated to the east. The Town of Newcastle will pay for all land surveys and legal costs associated with the purchase. In addition, they are prepared to offer you $500.00 as compensation for the required property. Should you agree with the terms and conditions of the land purchase as stated in this letter, please sign in the space allocated on the attached sheet to formally acknowledge your approval. Kindly return one copy of the signed letter to our office in the envelope provided by June 2, 1993. Upon receipt of the signed letter, we will direct the Land Surveyors and Town Solicitor to proceed with the necessary agreements and reference plans. All conditions as stated herein are subject to the approval of the Council of the Town of Newcastie. We thank you for your cooperation regarding this matter.
