By-Law Number 93- 188
Being a By-law to amend By-law 84-63, the Comprehensive By-law for the former
Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Municipality of Clarington deems it
advisable to amend By-law 84-63, as amended, of the former Town of Newcastle in
accordance with Rezoning Application DEV 90-44 to permit the development of a 57 unit,
5 storey apartment building and to recognize the Vanstone Mill, Stable, Miller's House and
the associated lands to the north for commercial uses;
AND WHEREAS the Council of the Corporation of the Municipality of Clarington in
approving the application, deems it appropriate to incorporate a "Holding (H)" symbol on
said lands which would be removed at such time that the provisions of Section 3.9 within
the former Town of Newcastle Comprehensive Zoning By-law have been satisfied;
AND WHEREAS said By-law shall be passed pursuant to Section 24(4) of the Planning
Act, whereby it would not come into effect until such time as the related Official Plan
Amendment has received approval from the Ministry of Municipal Affairs or the Ontario
Municipal Board;
NOW THEREFORE BE IT RESOLVED THAT the Council of the Municipality of
Clarington enacts as follows:
1. Section 15.4 "Special Exception-Urban Residential Type Four (R4) Zone" is hereby
amended by adding thereto, the following new Special Exception 15.4.13 as follows:
15.4.13 "Urban Residential Exception (R4-13) Zone:
Notwithstanding Section 15.2 a), e), g) and Section 3.19 a)those lands zoned (R4-13)
as shown attached Schedule "A' shall be used for an apartment building and shall be
subject to the following zone provisions:
a) dwelling units (maximum) 57 units
b) lot coverage (maximum) 45%
c) building height (maximum) 5 storeys or 21
metres; whatever is
less
d) setback requirements from
Environmental Protection (EP) zone nil

2. Section 16.5 "Special Exception General Commercial (Cl) zone is hereby amended
by adding the following new special exception 16.5.12 as follows;
16.5.12 "General Commercial Exception (C1-12) Zone":
Notwithstanding Section 16.3 a) and d) and Section 3.19 a) those lands zoned (C1-
12) as shown on Schedule "A' shall be subject to the following zone provisions:
a) front yard (minimum) nil
b) building height (maximum) 17 metres
c) setback requirements
where the existing Mill abuts an
Environmental Protection (EP) zone 1 metre
d) Notwithstanding the setback requirements of Section 3.19 as amended by
16.5.12(c), any new structure shall be set back a minimum of 30 metres from
the edge of the Bowmanville Creek.
3. Schedule "3" to By-law 84-63 as amended is hereby further amended by changing the
zone category from:
"Environmental Protection (EP) Zone" to "Holding(H)-Special Exception
Urban Residential Type Four (R4-13) Zone" and;
"Environmental Protection (EP) Zone" to "Holding(H)-Special Exception-
General Commercial (C1-12) Zone".
4. Schedule "A" attached hereto shall form part of this By-law.
5. This By-law shall come into effect on the date of the passing thereof, subject to the
provisions of Section 24(4) and Section 34 of the Planning Act.
