THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY-LAW 93-119
Being a By-law to authorize the execution of a
Transfer in favour of a Quit Claim to the owners
abutting the portion of the unnamed street between
Blocks 13 and 10, according to the Plan of the
Village of Orono made by C.G. Hanning and to repeal
By-law 92-235
THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON HEREBY ENACTS AS
FOLLOWS:
1. THAT relevant portions of the stopped up and closed public
highway be conveyed to the abutting owners for a nominal
consideration subject to the satisfaction of all of the
condition set out in Paragraph 2.
2. (a) A Reference Plan be prepared and deposited at no cost
to the Municipality showing the entire part of the
unnamed street between Blocks 13 and 10, according to the
Plan of the Village of Orono made by C. G. Hanning which
Plan shall delineate in separate parts portions of such
lands to be conveyed to the owners of each of 139 and
147 Mill Street North, together with a part delineating
the remainder of the unnamed street.
(b) Each owner of 139 and 147 Mill Street North respectively
who wishes to obtain a transfer from the Municipality
consent and agree, in writing, to the conveyance to the
other owner of the part of the unnamed street located
within the boundaries described in the most recent
transfer registered in favour of such other owner.
(c) The form of conveyance to each of the owners be in the
form of a Quit Claim Transfer, that is, the transfer does
not contain any warranty by the Municipality as to its
title.
(d) Each owner, at the time of the transfer, pay the
Municipality's legal expense which is determined by
the Administrator to be associated with the transaction.
(e) Each owner to whom a transfer is made provides an
Indemnity in favour of the Municipality in the form
required by the Municipality's current road closing and
conveyance policy.
3. THAT By-law 92-235 be repealed.
By-law read a first and second time this 19th day of July, 1993.
By-law read a third time and finally passed this 19th day of
July, 1993.
