THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW # 93-74
being a by-law to amend By-law No. 92-105
which imposed development charges under the
Development Charges Act.
WHEREAS in accordance with Section 4 of the Development Charges
Act notice was given of a public meeting which was held by the
Council of The Corporation of the Town of Newcastle on May 31,
1993 to consider a proposal to amend By-law No. 92-105 respecting
adjustments to be made to development charges imposed pursuant to
By-law No. 92-105;
WHEREAS at the public meeting which was held on May 31, 1993,
Council heard all persons who applied to be heard in objection to
the aforesaid proposed amendment to By-law No. 92-105 and
considered all written communications;
WHEREAS Council has approved Report #PD-64-93 on April 19, 1993,
NOW THEREFORE the Council of The Corporation of the Town of
Newcastle enacts as follows:
1. Section 10 of By-law No. 92-105 is amended by renumbering it
as Subsection 10(1).
2. By-law No. 92-105 is further amended by adding new
Subsections 10(2), 10(3) and 10(4) as follows:
"10(2) Despite subsection 10(1) of this By-law,
subsection 10(1) shall not apply to require an adjustment to
be made to development charges imposed pursuant to this By-
law on April 1, 1993 and on any date thereafter.
10(3) Commencing on November 1, 1994 development charges
imposed pursuant to this By-law shall be adjusted semi-
annually, without amendment to this By-law on the 1st day of
May and the 1st day of November in accordance with the
Engineering News Record Building Cost # Indexes for 22
cities for Toronto for the most recently available six month
period, the first of such adjustments to be made on November
1, 1994 for the six month period which commences on May 1,
1994.
For the avoidance of doubt, the adjustments to be made on
November 1, 1994 shall be made to the amounts which are the
aggregates of the development charges and the adjustments
made on October 1, 1992 in accordance with subsection 10(1)
of this By-law.
10(4) Despite the provisions of subsections 10(1) and
10(3) of this By-law, no person who in fact pays development
charges to The Corporation of the Town of Newcastle at any
time from October 1, 1992 to and including October 31, 1994
shall be required to pay either more or less than the amount
of the development charges imposed pursuant to this By-law
together with the adjustment thereto made on October 1, 1992
in accordance with subsection 10(1) of this By-law."
By-law read a first and second time this 31st day of May 1993.
By-law read a third time and finally passed this 31st day of May
1993.
