WHEREAS the Ontario Municipal Board under appeal by the Bowmanville Co-Operative of rezoning application DEV 89-30 within the Town of Newcastle deems it advisable to amend By-law 84-63, as amended, of the Corporation of the Town of Newcastle. NOW TJ-IEREFORE BE IT RESOLVED THAT the Ontario Municipal Board amends as follows: 1. Section 15.4 . Special Exceptions - Urban Residential Type Four (R4) zone, is hereby further amended by adding thereto the Special Exception 15.4.12 as follows: .15.4.12 URBAN RESIDENTIAL EXCEPTION (R4-12) ZONE Notwithstanding Section 15.1 and 15.2, those lands zoned (H) R4-12 on the Schedules to this By-law shall be subject to the following zone provisions: a) Residential USc;:S i) an apartment building ii) a link townhouse dwelling b) Regulations for Residential Uses i) ii) iii) iv) v) vi) vii) viii) ix) 30 units per Ha density (maximum) number of units (maximum) a) apartment units . b) link townhouse units yard requirements apartment building (minimum) a) to top of bank b) to east lot line yard requirements link townhouse dwelling (minimum) a) to top of bank b) to east lot line c) to north lot line building height (maximum) lot coverage (maximum) landscape open space (minimum) link townhouse dwelling unit area (minimum) parking requirements (minimum) 26 42 10.0 m 12.0 m 5.0 III 8.0 m 6.5 m 10.5 In 20 % 70 % . 60 square metres 130 parking splices. 2. Schedule .3. to By-law 84-63 as amended, is hereby further amended by changing the 1.one designation from .Urban Residential Type One (Rl). and .Urban Residential Type One - Bohling ((H)Rlr zone to .Urban Residential Exception - Holding ((H)R4-12). and . Envirunmental Protection (EP), as indicated on the attached Schedule . A. hereto. 3. For the purpose of this by-law, the term .Parking space. shall mean an area for the parking or storage of motor vehicles and may include a private garage as well as the driveway in front of a private garage. 4. Schedule.
