THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 92-85
being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law for the Corporation of the
Town of Newcastle.
WHEREAS the Ontario Municipal Board under appeal by the Bowmanville Co-Operative of rezoning
application DEV 89-30 within the Town of Newcastle deems it advisable to amend By-law 84-63, as
amended, of the Corporation of the Town of Newcastle.
NOW TJ-IEREFORE BE IT RESOLVED THAT the Ontario Municipal Board amends as follows:
1. Section 15.4 . Special Exceptions - Urban Residential Type Four (R4) zone, is hereby further
amended by adding thereto the Special Exception 15.4.12 as follows:
.15.4.12 URBAN RESIDENTIAL EXCEPTION (R4-12) ZONE
Notwithstanding Section 15.1 and 15.2, those lands zoned (H) R4-12 on the Schedules to this
By-law shall be subject to the following zone provisions:

designation from .Urban Residential Type One (Rl). and .Urban Residential Type One - Bohling
((H)Rlr zone to .Urban Residential Exception - Holding ((H)R4-12). and . Envirunmental Protection
(EP), as indicated on the attached Schedule . A. hereto.
3. For the purpose of this by-law, the term .Parking space. shall mean an area for the parking
or storage of motor vehicles and may include a private garage as well as the driveway in front of a
private garage.
4. Schedule. A. attached hereto shall form part of this By-law.
