HomeMy WebLinkAbout92-195 DN: RM-BYL THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 92 -195 being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law for the Corporation of the Town of Newcastle, WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By-law 84-63, as amended, of the Corporation of the Town of Newcastle to recognize a year round Mobile Home Park having eighteen (18) units as proposed through Application DEV 89-112. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of Newcastle enacts as follows: 1. Section 10 "Residential Mobile Home Park (RM) zone is hereby amended by adding thereto the following new Section 10.5 and Section 10.5.1: "10.5 SPECIAL EXCEPTIONS - RESIDENTIAL MOBILE HOME PARK (RM) ZONE 10.5.1 RESIDENTIAL MOBILE HOME PARK EXCEPTION (RM-1) ZONE Notwithstanding Section 10.1, 10.2, 10.3 and 10.4 those lands zoned "RM-1" on the schedules to this By-law shall be subject to the following zone regulations: a) Residential Uses i) a mobile home park existing at the date of passing of this by-law ii) an existing single family dwelling b) Non-Residential Uses i) ii) a mobile home park maintenance depot a retail sales and/or service establishment with outdoor display areas for recreational vehicles, equipment and accessories c) Regulations for Residential Uses i) ii) iii) iv) Mobile Home Units (maximum) 18 units Mobile Home Site Area (minimum) 250 square metres Mobile Home Floor Area (minimum) 40 square metres Mobile Home Side Yard Setbacks (minimum) for the purposes of this Subsection, the definition of front, rear and side yard shall apply to mobile home site. Schedule "5" to By-law 84-63 as amended, is hereby further amended by changing the zone designation from: "Special Purpose Commercial Exception (C4-8)" to "Residential Mobile Home Park - Special Exception (RM-1)", as shown on the attached Schedule "A". ...,2 - 2 - 3. Schedule "A" attached hereto shall form part of this By-law. 4. This By-law shall come into effect on the date of the passing hereof, subject to the provisions of Section 34 of the Planning Act.
