HomeMy WebLinkAbout92-19 ~ ~ . - DN: DEV91025.GPA THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 92-12- being a By-law to amend By-law 84-63, the Comprehensive Zoning By- law for the Corporation of the Town of Newcastle. -, WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By-law 84-63, as amended, of the Corporation of the Town of Newcastle to permit the development of a 39 unit pln of subdivision (18T-89115). NOW THEREFORE BE IT RESOLVED THAT the Council of the corporation of the Town of Newcastle enacts as follows: 1. Schedule 114'1 to By-law 84-63 as amended, is hereby further amended by Changing the zone d~signation from "Agricultural (A) 'I to "Urban Residential Type Two - Holding ((H) R2) n Zone and from l'Agricu~tural (A) n to ~'Environmental Protection (EP) n, as illustrated on the attached Schedule nAI' hereto. 2. Schedule "A" attached hereto shall form part of this By-law. 3. This By-law shall come into effect on the date of the passing hereof, subject ,to the provisions of section 34 of the Planning Act. WHEREAS the Council of the Corporation of the Town of Newcastle deems it desirable. to exempt from Part Lot Control, Lots 1 to 26 all inclusive on Plan 40M-1669 registered at the Land Registry Office for the Land Registry Division of Whitby (No. 40) October 9, 1991. NOW THEREFORE BE IT RESOLVED THAT THE Council of the Corporation of the Town of Newcastle enacts as follows: 1. THAT Subsection (5) of section 49 of the Planning Act shall not apply to those lands described in Paraqraph 2 within the By- law. 2. THAT this By-law ~h~ll 'come into effect upon being approved .. .. by the Regional Municip&lity of Durham and thereafter Subsection . (5) of section 49 shall cease to apply to the following lands: Lots 1 to 26 all inclusivp on Plan 40M-1669. BY-LAW read a first time this 13th day of January , 1992.
