THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 92 -182 being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law for the Corporation of the Town of Newcastle. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By-law 84-63, as amended, of the Corporation of the Town of Newcastle in accordance with application DEV 87-101 to permit the development of twenty eight (28) residential units. WHEREAS the Council of the Corporation of the Town of Newcastle recommends to the Region of Durham for approval of draft Plan of Subdivision 18T-87083. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of Newcastle enacts as follows: Section 9.1 "Residential Hamlet (RH)" is hereby amended by adding thereto, the following Special Exceptions 9.3.17 and 9,3.18 as follows: "9.3.17Residential Hamlet Exception (RH-17) zone Notwithstanding Section 9.2 those lands zoned RH-17 on the schedules to this By-law shall be subject to the following zone requirements: (a) Lot Area (minimum) (b) Lot Frontage (minimum) "9.3.18 Residential Hamlet Exception (RH-18) zone Notwithstanding Section 9.1 those lands zoned RH-18 on the schedules to the By-law shall only be used for single dwelling residential units when municipal water and sanitary sewer are available." 1. 2000 square metres 27 metres" 2. Schedule "17" to By-law 84-63 as amended, is hereby further amended by changing the zone designation from: "Agricultural (A)" to "Environmental Protection (EP) " "Agricultural (A)" to "Residential Hamlet Exception (RH-18) " "Agricultural (A)" to "Holding -Residential Hamlet Exception ((H)RH-17)" "Agricultural (A)" to "Residential Hamlet (RH)" and "Residential Hamlet (RH)" to "Holding - Residential Hamlet Exception ((H)RH-17)" as shown on the attached Schedule " A "hereto. 3. Schedule" A" attached hereto shall form part of this By-law. 4. This By-law shall come into effect on the date of the passing hereof, subject to the provisions of Section 34 of the Planning Act.
