HomeMy WebLinkAbout85-65 --T 4 #' THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW 85-65 being a by-law to authorize the execution of Supplementary Agreement #13 with Ontario Hydro (Advancement of Improvements to the Bowmanville Memorial Hospital) THE COUNCIL OF THE CORPORATION OF THE TOWN OF NEWCASTLE HEREBY ENACTS AS FOLLOWS: THAT THE Mayor and Clerk are hereby authorized to execute on behalf of the Corporation of the Town of Newcastle and seal with the Corporation Seal, Supplementary Agreement #13, between Ontario Hydro and the said Corporation, in respect of Advancement of Improvements to the Bowmanville Memorial Hospital, a copy of which is attached as Schedule "X". DARLINGTON GENERATING STATION SUPPLEMENTARY AGREEMENT NO. 13 ADVANCEMENT OF IMPROVEMENTS TO THE BOWMANVILLE MEMORIAL HOSPITAL THIS AGREEMENT made ~n triplicate this BE1'WEEN: day of 19 ONTARIO HYDRO Hereinafter referred to as the "Corporation" OF THE FIRST PART -and- THE CORPORATION OF THE TOWN OF NEWCASTLE Hereinafter referred to as the "Town" OF THE SECOND PART -and- THE REGIONAL MUNICIPALITY OF DURHAM Hereinafter referred to as the "Region" OF THE THIRD PART Whereas the Corporation and Town have entered into an Agreement (hereinafter referred to as the Newcastle Agreement), wit~ respect to the social, economic and financial impacts arising out of the construction and operation of the Darlington Generating Station (hereinafter referred to as the Station) on the Town dated March 22, 1977; ....Page 2 - 2 - AND WHEREAS the Corporation, the Town and the Region have entered into an Agreement (hereinafter referred to as the Regional Agreement) with respec~ to the social, economic and financial impacts arising out of the construction and operation of the Station on the Region and the Town, dated August 8, 1977: AND WHEREAS the Newcastle Agreement and the Regional Agreement provide for the entering into supplementary agreements between the Corporation, the Town and the Region: AND WHEREAS the Corporation, the Town and the Region have entered into a Supplementary Agreement entitled Community Impact Monitoring Program which involves collecting and updating data on certain impact items which may be affected by the construction and operation of the Station; AND WHEREAS data has been collected regarding future impacts on heplth services provided by Bowmanville Memorial Hospital and all parties have agreed upon an assessment of the increase in demand placed upon the hospital by the growing inflow of Darlington construction workers and their families, it is deemed necessary to advance funds to advance improvements to the hospital services and facilities: ....Page 3 l ." . ." , - 3 - AND WHEREAS the Corporation, the Region and the Town agree that the Town and the Bowmanville Memorial Hospital Board of Trustees have undertaken initiatives to advance improvements to the hospital services and facilities, due in part to ~he influx of Darlington construction workers and their famil~esi NOW, THEREFORE, WITNESSETH that in consideration of the covenants hereinafter contained and for other good and valuable consideration, the Corporation, the Town and the Region hereby agree as follows: 1. The Corporation agrees to pay the Town from Station Account "B" the sum of $224,200 in advance of the future financial impact to be incurred by the Town in advancing improvements to Bowmanville Memorial Hospital services and facilities. Payment of silid StUll will be divic1C'd into two I?Llrts: $124,200 in 1985 and $100,000 in 1986. 2. The Corporation agrees to pay the Town from Station Account "A" up to $135,000, being the estimated cost of construction and equipping a special contaminated patient emergency operating room at Bowmanville Memorial Hospital designed to meet the health and safety requirements of the Corporation. Up to 75 per cent of said payment will be made to the Town after submission to the Corporation of detailed drawings and est.imates for constructing and equipping a special contaminated patient emergency operating room at Bowmanville Memorial Hospital. . . . . Page 4 ., ,.", . , , - 4 - Final payment will be made to the Town upon completion by the Hospital of said operating room. The recitals mentioned in this Agreement form part of this Agreement. IN WITNESS WHEREOF the Corporation, the Town and the Region have caused this Agreement to be executed by the affixing of the corporate seals attested by the signature of their proper officers duly authorized in that behalf.
