BY-LAW 85-101
being a by-law to authorize the execution of
Supplementary Agreement #14 with Ontario Hydro
(Advancement of Facilities for Law Enforcement
Activities)
THE COUNCIL OF THE CORPORATION OF THE TOWN OF NEWCASTLE
HEREBY ENACTS AS FOLLOWS:
THAT the Mayor and Clerk are hereby authorized to execute,
on behalf of the Corporation of the Town of Newcastle, and
Seal with the Corporation Seal, Supplementary Agreement #14,
between Ontario Hydro and the said Corporation, in respect
of Advancement of Facilities for Law Enforcement Activities,
a copy of which is attached as Schedule "X".
By-law read a first and second time this 9th Day of September 1985
By-law read a third time and finally passed this 9th day of
September 1985.

ADVANCEMENT OF FACILITIES FOR LAW
ENFORCEMENT ACTIVITIES

Hereinafter referred to as the "Corporation"
OF THE FIRST PART

Hereinafter referred to as the "Town"
OF THE SECOND PART

THE REGIONAL MUNICIPALITY OF DURHN~
Hereinafter referred to as the "Region"
OF THE THIRD PART
Whereas the Corporation and Town have entered into an Agreement
(hereinafter referred to as the Newcastle Agreement), with respect
to the social, economic and financial impacts arising out of the
construction and operation of the Darlington Generating Station
(hereinafter referred to as the Station) on the Town dated
March 22, 1977;

AND WHEREAS the Corporation, the Town and the Region have entered
into an Agreement (hereinafter referred to as the Regional
Agreement) with respect to the social, economic and financial
impacts arising out of the construction and operation of the
Station on the Region and the Town, dated August 8, 1977;
AND WHEREAS the Newcastle Agreement and the Regional Agreement
provide for the entering into supplementary agreements between
the Corporation, the Town and the Region;
AND WHEREAS the Corporation, the Town and the Region have
entered into a Supplementary Agreement entitled Community Impact
Monitoring Program which involves collecting and updating data
on certain impact items which may be affected by the construction
and operation of the Station;
AND WHEREAS the Regional Agreement provides that the Corporation
agrees to compensate the Region for those financial impacts
undergone by the Region as a result of the construction of the
Station which include the cost of advancing community facilities
and providing such community services as law enforcement;
AND WHEREAS data has been collected regarding future impacts on
law enforcement activities provided by the Durham Regional Police
Force and all parties have agreed upon an assessment of the increase
in demand placed upon the law enforcement facilities and services

by the growing inflow of Darlington construction workers and
their families, it is deemed necessary to advance funds to
advance construction of a police station in the Town and
improvements to Durham Regional Police Force services by four
(4) years.
NOW, THEREFORE, WITNESSETH that in consideration of the covenants
hereinafter contained and for other good and valuable consideration,
the Corporation, the Town and the Region hereby agree as follows:
1. The Corporation agrees to pay the Region from Station Account
"B" the sum of $193,000 in advance of the future financial
impact to be incurred by the Region in advancing construction
of a new Durham Regional Police Force Station and improvements
to law enforcement services in the Town of Newcastle.
2. Payment of said funds is subject to an award by the Region
of a contract for the Town of Newcastle police station on
or before December 31, 1985. The Region will submit to the
Corporation a copy of the tender award and an invoice for
$193,000 in order to receive payment.
3. In the event a contract is not awarded by the Region on or
before December 31, 1985 for the Town of Newcastle police
station payment will be reduced by $4,000 per month delay.

The recitals mentioned in this Agreement form part of this
Agreement.
IN WITNESS WHEREOF the Corporation, the Town and the Region
have caused this Agreement to be executed by the affixing of
the corporate seals attested by the signature of their proper
officers duly authorized in that behalf.
