BY-LAW 82- 34
being a by-law to authorize the execution
of an agreement with Reg. T. Smith Construction
for the reconstruction of the Bowmanvi11e
Museum Porch
The Council of the Corporation of the Town of Newcastle
HEREBY ENACTS AS FOLLOWS:
. THAT the Mayor and Clerk are hereby authorized to execute on behalf
of the Corporation of the Town of Newcastle and seal with the
Corporation Seal, an agreement between Reg. T. Smith Construction and
The Corporation of the Town of Newcastle for the reconstruction of the
porch on the Bowmanvi11e Museum, located at 37 Silver Street.

Between: THE CORPORATION OF THE TOWN OF NEWCASTLE
hereinafter called the "Town"
of the first part
and

hereinafter called the "Contractor"
of the second part
WHEREAS Council deems it appropriate to enter into an Agreement for the
reconstruction of the porch of the Bowmanvi11e Museum Building, Silver Street,
Bowmanvil1e; and
WHEREAS the Contractor has offered to undertake the reconstruction on the
basis of the drawings and specifications prepared for the Bowmanvi1le Museum
Board by D. A. G. Mills, Architect; and
WHEREAS the Town has approved the drawings and specifications and has invited
public proposals to undertake the reconstruction:
NOW THEREFORE in consideration of the promises and mutual covenants and agreements
herein contained, the parties hereto mutually covenant and agree as follows:
1. The Contractor agrees to reconstruct the porch of the
Bowmanvil1e Museum in accordance with the plans and
specifications prepared by D. A. G. Mills Ltd, and
attached hereto as Schedule IIA" to this Agreement; and
2. The Contractor agrees to undertake (1) above in accordance
with his proposal of December 15 1981, attached hereto
at the cost specified; and
3. The Contractor agrees to save harmless, the Town from any
damage, injury, actions or causes of actions resulting from
the performance of the work specified in this agreement.

In Witness Whereof the parties have duly authorized
this Agreement.

We carry public Liability for personal injury of $500,000.00
We are also covered by Workmans Compensation.
Further to the plans, our execution of the job will consist of the dipping of the
material into the preservative rather than using the brush or roller. This will give
better penetration.
If the job is undertaken during the winter months, we would have to bring all of
the framing material into the shop to thaw it out and dry it a little, otherwise
there would be little or no penetration of the preservative into the spruce.
The pine flooring would be all right, because it is under cover.
We also use galvanized nails on all exterior work. This is a further protection of
. rusting and wood rotting around the nails and the discolouring of the paint.
During the course of construction, we paint all end cuts of beams, joists and fl~ring
