THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NO. 82-189
being a by-law to authorize the Mayor and
Clerk to execute an Offer to Sell related
to lands required for the future reconstruction
of Golf Course Road, in the former Township of
Clarke
The Council of the Corporation of the Town of Newcastle hereby
ENACTS AS FOLLOWS:
1. The Mayor and Clerk are hereby authorized to execute an Offer
to Sell related to the lands required for the future reconstruction
of Golf Course Road in the former Township of Clarke between:
(a) The Town of Newcastle and Mr. & Mrs. T. W. Wilson
for a portion of Lot'21, Concession 2, former Township
of Clarke, being an area of 0.145 acres, more or less; and
(b) The Town of Newcastle and Newcastle Golf Course, for a portion
of Lot 20" Concession 2, former Township of Clarke, being an
area of 9.938 acres, more or less; and
(c) The Town of Newcastle and the Estate of Robert Charles Simpson
for a portion of Lot 20, Concession 2, former Township of Clarke,
being an area of 0.005 acres, more or less; and
(d) The Town of Newcastle and Andrzei and Krystyna Dziamarski for
a portion of Lot 21, Concession 2, former Township of Clarke,
being an area of 1.066 acres, more or less.
2. That Schedule "X" attached hereto forms part of this by-law.
BY-LAW read a first and second time this 20th day of December 1982

PR0VIDED the title is good and free from all encumbrances. The Purchas~r is to b~
allowed sixty (60) days from the date of acceptance h~reof to investigate the title
a~ its own expense and if within that time it shall furnish the Vendor in writing
with any valid oLjection to the title which the Vendor shall be unable or unwillinQ
to remove, a~d which Purchaser will not waive, this agreement shall be null and void.
Adjustments to be proportioned and allowed to thE- date of completion of sale.
THIS offer to b~ accepted by the Purchaser within sixty (60) days of the date herein,
otherv.1ise this offer becomes null and void; and the sale to be completed on or before
sixty (60) days from the date of acceptance hereof on which date vacant possession
of the said premises is to be given to the Purchaser. This Offer, when acc~pted,
shall constitute a binding contract of purchase and sale and time in all resp~cts
shall be the essence of this agreement. It is agl:eed that there is no representation,
warranty, collateral agreement or condition affecting this agreement or the real
property or supported hereby other than as expressed herein in writing.

ADDITJONALLY,the Purchaser agrees with the Vendor(s) to the following terms and
conditions:

The purchaser agrees to pay reasonable fees for legal services required by the vendor
to complete this transaction.
No mature trees are to be removed unless it is absolutely necessary to accommodate
construction of the road.

attached sketch (Appendix B) with any alterations to be agreed'upon by the owner and
the construction engineer for the Town of Newcastle.
