THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW 82 - 179 being a by-law of the Corporation of the Town of Newcastle to appoint a By-Law Enforcement Officer The Municipal Council of the Corporation of the Town of Newcastle HEREBY ENACTS AS FOLLOWS: 1. That Mr. R. Goodwin is hereby appointed By-Law Enforcement Officer to the Town of Newcastle; 2. That Mr. R. Goodwin shall be paid for his services in accordance with the terms and conditions as set out in Schedule "A" attached hereto; 3. That Mr. R. Goodwin shall commence his duties as By-Law Enforcement Offi cer on December 14, 1982 ; 4. That By-Law 81-91 is hereby repealed. By-Law read a first time this 13th day of December 1982 By-Law read a second time this 13th day of December 1982 By-Law read a third time and finally passed this 11th day of December 1982 "/~ /,,/~ . .~ Mayor two a1tiA I File NO.mu-1J)...:.lSL19..__._1 REPEALED BY 8Y-LAW l2:i;.g2~ SCHEDULE I'A" TO BY-LAW 82 - 179 Terms and Conditions of Employment of Raymond Goodwin as By-Law Enforcement Officer, Town of Newcastle The following shall be the terms and conditions of employment of Raymond Goodwin as By-Law Enforcement Officer, Town of Newcastle, namely: 1. Effective December 13 1982, Raymond Goodwin shall commence his employment with the Corporation of the Town of Newcastle as By-Law Enforcement Officer. 2. The duties and responsibilities of the By-Law Enforcement Officer are those established by By-Law 81-190 as may be amended from time to time. 3. R. Goodwin shall be renumerated at Step 2, Grade 9 of the salary administration program for non-affiliated staff and shall be entitled to all other benefits accorded to non-union staff from time to time. 4. R. Goodwin's employment as By-Law Enforcement Officer shall be conditional on a three month probationary period, at the expiration of which his performance shall be evaluated by the Clerk and Chief Administrative Officer. If in their opinions his performance is not satisfactory, then his services may be terminated. 5. R. Goodwin's employment as By-Law Enforcement Officer shall be conditional on his successful completion of such employee development and training courses, as may be required by the Clerk. 6. R. Goodwin's employment shall be for a period of one year from the start of his employment as By-Law Enforcement Officer; at which time his job performance shall be evaluated by the Clerk and Chief Administrative Officer and this agreement either extended without any qualification as to a period of employment; extended with a further mutually satisfactory period of employment; or R. Goodwin's services may be terminated at that time. In the case of the latter, the Corporation shall consider offering employment to R. Maintain a positive corporate image. (b) L icen_sj~ 1. Provide information and interpretation of licensing by-law requirements and procedures, to the public, staff and outside agencies. 2. Receive and process applications required by the by-laws of the Town of Newcastle and, inform applicants of the requirements of the Corporation relating to the issuing of licences. 3. Certify and approve licences and renewals for issue when all conditions have been met. 4. Administer the program associated with the issuing of licences and renewals of licences. 5. Undertake the processing and follow-up on complaints related to alleged violations of the licensing by-laws, including investigation and pl'osecut ion where necessary. 6. Provide investigative services to the Town's Solicitor relating to Municipal offences when necessary. 7. Review and recommend changes to procedures as they relate to the general licensing process. R. Maintain an awareness of legislative changes as they relate to the general licensing activity. 9. Develop and maintain accurate records of all activities associated with the 1 icellsill~J lunction. 10. Undertake other related duties as may be assigned by the Clerk from time to time. QUALI FI CAT! ( , " "'..,......,~-'"...._---~._._---_._-- . .. ~ SCHfDULf "A" TO BY-LAW NO. 8~- 179 Position Title: By-law Enforcement Officer Department: Clerk's Department SUMMARY OF DUTIES: 1. Responsible for the enforcement of all municipal by-laws, including the investigation of all complaints and where appropriate the prosecution of persons contravening the Town's zoning, licensing and property related by-laws. 2. Responsible for the day-to-day supervision and management of the Animal Control Section, Parking, School ,Crossing Guards, Taxi-Cab and Taxi Driver licenSing programs, fence viewers. 3. Act as the Town prosecutor in all by-law related cases as required. DUTIES AND RESPONSIBILITIES: (a) By-law and Agreementj:nforcement 1. Provision of general information and interpretation of the Town's by-laws and agreements to the public, municipal officials, and outside agencies, or groups. 2. Receive, catalogue and determine the nature of all complaints as they relate to the enforcement of the Town's By-laws. 3. Ensure that the correct administrative action is taken and that complaints are satisfactorily resolved, either through the By-law Enforcement section of the Clerk's Department, or by referral to the appropriate department, or agency. 4. Undertake the investigation and documentation of all alleged infractions for court acticJ where necessary. 5. Provision of proper follow-up procedures of cases after prosecution to ensure compliance with the Court's Order. 6. Preparation of the annual operational budget for the activities managed by the By-law Enforcement Section. 7. Review and where appropriate, recolmlend revisions to existing by-laws in consultation with the responsible department. 8. Develop and maintain accurate records of all activities relating to the By-law Enforcement Section.
