THE CORPORATION OF THE TOWN OF NEWCASTLE
BY -LAW NUMBER 82- 165
being a By-law to amend Restricted Area By-law 79-44, as amended, of
the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend Restricted Area By-law 79-44, as amended, of
the Town of Newcastle;
NOW THEREFORE, the Council of the Corporation of the Town of
Newcastle enacts as follows:
1. Subsection 13 (h), entitled "Special Exemption", of Section
3, entitled "General Provisions", of By-law 79-44 is hereby deleted
in its entirety.
2. Schedule "A" of By-law 79-44, as amended, is hereby further
amended by changing to "SPECIAL CONDITION 5" the lands shown
cross-hatched and marked on Schedule "A" hereto with the Figure 5
encircled and shown as "SPECIAL EXEMPTION TO SPECIAL CONDITION 5".
3. By-law 79-44 is hereby further amended by adding to Schedule
"B", the following:
"SPECIAL CONDITION 5
Those lands located on the west side of Graham Creek, north
of Lake Ontario, shown cross-hatched with the Figure 5
enci rcl ed on Schedul e "A II by By-l aw 79-44 as amended, may be
used for the following uses provided such uses comply with
the provisions of Schedules "Al" and IA2" attached hereto.
Where there is any conflict between the regulations
hereinafter set out and any other provisions of By-law
79-44, then the provisions of this SPECIAL CONDITION shall
apply, but in all other respects the provisions of By-law
79-44, as amended, shall apply.
1. Defined Areas:
The areas subject to this SPECIAL CONDITION shall
consist of 6 Blocks, labelled on Schedule "A-l -
DETAIL OF SPECIAL CONDITION 5" to this By-law as
Blocks A, B, C, D, E, and F.

2. Definitions:
ASSEMBLY HALL/CONFERENCE CENTRE: shall mean a building or part
of a building on which facilities are provided for such purposes
as meetings for educational, political, religious, civic or social
purposes and may include a banquet hall, private club or fraternal
organization and a hotel or motel.
RETAIL COMMERCIAL STORE: shall mean a retail commercial
establishment supplying groceries and other daily necessities to
the users of the marina and residents of the immediate area.
COMMERCIAL OFFICE/OFFICES: shall mean a building or part of a
building used wholly or partially for the purpose of general or
,private offices incidental or accessory to the use of the building
in which they are located or which serve the users of the marina
and residents of the immediate area.
RESIDENTIAL DWELLING UNIT: shall mean a room or a suite of two or
more rooms, designed or intended for use by, or actually used by,
a family, an individual or group of individuals in which room or
suite of rooms sanitary conveniences are provided, and culinary
conveniences may be provided for the exclusive use of such
individual, family or group of individuals.
EATING HOUSE/RESTAURANT: shall mean a building or part of a
building including a part of an apartment building where
facilities are provided for the preparation, serving and
consumption of food.
LANDSCAPED AREA: shall mean an open unobstructed space from
ground to sky at grade, accessible to pedestrians, which is
suitable for the growth and maintenance of grass, flowers, bushes,
trees or other similar landscape materials and may include any
walkways, patios or similar areas but shall not include any
driveway or ramp, parking area or any open space beneath or within
any building or structure.
MARINA: shall mean a building, structure, or place containing
docking facilities and located on a navigable waterway, where
boats and boat accessories are stored, serviced, repaired or kept
for sale and where facilities for the sale of marine fuels and
lubricants may be provided.
PARK, PRIVATE: shall mean any open space or recreational area,
other than a public park, owned and operated or maintained in
whole or in part for profit or private use by a private
corporation, club or fraternal organization for members only, and
may include therein swimming, wading and boating facilities,
including boat storage, picnic areas, ski areas, tennis courts,
gardens, refreshment rooms and other similar structured or
unstructured recreational areas.
PARK, PUBLIC: shall mean any space or recreational area, owned or
controlled by the Town or any Board, Commission or other Authority
established under any statute of the Province of Ontario or the
Dominion of Canada and may include therein neighbourhood,
community, regional and special parks or areas and may include one
or more athletic fields, field houses, community centres,
bleachers, swimming pools, greenhouses, botannical gardens,
zoological gardens, bandstands, skating rinks, tennis courts,
bowling greens, boat liveries, bathing stations, curling rinks,
refreshment rooms, fair grounds, arenas, tent or trailer camp or
park, golf courses, or similar uses.

2. Definitions:(Cont'd)
PARKING AREA: shall mean an area or structure provided for the
parking of motor vehicles, including aisles having a minimum width
of 6 metres, parking spaces having a minimum width of 3 metres and
a minimum length of 6 metres and related ingress and egress lanes,
but this definition shall not include any part of a public street.
"parking Area" may include a private garage or carport.
SPORTS PAVILION: shall mean a building or structure for
recreational uses including such uses as a yacht club, swimming
pool and tennis courts.
WATER PURIFICATION PLANT & PUMPING STATIONS: shall mean a
building and structures owned and operated by a public authority
used for the pumping, storage and purification of water.
3. Permitted Uses and Zoning Provisions:
The areas subject to this "Special Condition", shown on Schedule
"A_l" to this By-law, shall be used in accordance with the
regulations contained in Schedule IA_2" to this By-law, governing
the use, erection, expansion and enlargement of buildings,
structures and facilities within the subject area."
