HomeMy WebLinkAbout82-16 ., .". ,. . THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 82-16 being a By-law to amend By-law Number 76-25, as amended, of the Corporation of the Town of Newcastle. WHEREAS the Council of the Corporation of the Town of Newcastle DEEMS it advisable to amend By-law 76-25, as amended, of the Corporation of the Town of Newcastle. NOW THEREFORE the Council of the Corporation of the Town of Newcastle ENACTS as follows: 1. Section 3, Subsection (11) of By-law 76-25, as amended, of the Corporation of the Town of Newcastle is hereby further . amended by adding thereto the following subsection (b): "(b) "Lot" shall mean a parcel of land which is capable of being legally conveyed in accordance with the provisions of Section 29 of the Planning Act (R.S.O. 1970)". 2. Section 3, Subsection (18) of By-law 76-25, as amended, of the Corporation of the Town of Newcastle is hereby further amended by adding thereto the following subsection (b): "(b) "SIGN, DIRECTIONAL OFF-SITE" means a ground sign or wall sign which is located on a structure or a lot for the purpose of identifying a business or a service and providing directions to the lot upon which the business or service is located.". 3. Section 4, Subsection (6)(a) of By-law 76-25, as amended, of the Corporation of the Town of Newcastle is hereby further . amended by adding thereto the following sentence: "Notwithstanding the foregoing, a ground sign with a sign area of not more than 6.0 square feet and a height of not more than 5.0 feet may be permitted within the following zone classifications: C, CL, Cl, C3 and CD.". 4. Section 4, Subsection (6)(b) of By-law 76-25, as amended, of the Corporation of the Town of Newcastle is hereby further amended by deleting the words "be moved at its owner's expense to comply with the provisions of Section 4(6) (a) hereof." and replacing them with the following: I Fiie iIO.,c.{Q;I~.:/g.Lm_.....J . . . - 2 - . "be permitted to remain within the road allowance, subject to the written approval of the authority having jurisdiction over such road or street~ until such time as the sign must be relocated, either at the Owner's discretion or at the request of the authority having jurisdiction over the road or street in question. At2such time as any such sign is relocated or altered, in a manner which requires issuance of a sign permit, then all requirements of this by-law shall apply.". 5. Section 4 of By-law 76-25, as amended, of the Corporation of the Town of Newcastle is hereby further amended by the addition of the following subsections (10), (11) and (12): "(10) LEGAL NON-CONFORMING USES . In those cases where the existing use of a lot is legally non-conforming; that is, a use which legally existed prior to the passing of the applicable restricted area (zoning) by-law and has continued without change or interruption from that date but which does not comply or conform with the existing provisions of such restricted area (zoning) by-law; then the provisions of this Sign By-law, applicable to the zoning classification which most accurately reflects the legally non-conforming use of the lot shall apply. (11) OFF-SITE DIRECTIONAL SIGNS A maximum of two (2) off-site directional signs, having a sign area of not more than 5.0 square feet each, indicating the name or nature of a business or service and directions to the lot upon which such business or service is located, may be permitted within any zoning classification. (12) MOTOR VEHICLE SERVICE STATION OR GASOLINE BARS In addition to those signs permitted by Section 8(1)(a) of this by-law, Motor Vehicle Service Stations or Gasoline Bars shall be permitted to erect a maximum of two (2) Canopy or Pump Island Identification signs on the face of a weather canopy over fuel pump islands or in association with pump island lighting standards where there is no canopy. Pump Island or Canopy identification signs shall have a sign area of not more than 5.0 square feet.". . 6. Section 12, Subsection (4) of By-law 76-25, as amended, of the Corporation of the Town of Newcastle is hereby further amended by adding the word "promotion" after the words "message displayed by a" in the eleventh line thereof. 7. Section 12, Subsection (6) of By-law 76-25, as amended, of the Corporation of the Town of Newcastle is hereby further amended # . . . . . '" - 3 - by deleting the words "on or before the expiration of 5 years from the date of passing of this By-law" and adding thereto the following: '~ere existing signs, save and except signs located within a site triangle, signs overhanging a public road allowance or signs in excess of the permitted number of signs, predate the enactment of this By-law 76-25, and sufficient evidence is provided by the sign owner to the Chief Building Official to that effect, then such pre-existing signs may be permitted to remain until such time as any change is proposed which will require issuance of a sign permit pursuant to Section 12(4) of this By-law. At such time the subject sign(s) shall be made to conform to the provisions of this By-law in all respects.". 8. This By-law shall come into effect on the date of the final passing hereof.
