THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NO. 80-12l being a by-law to authorize the granting of a permanent easement over Part 2, Reference Plan lOR-ll45 and a temporary easement over Part 4, Reference Plan lOR-ll45 in favour of The Regional Municipality of Durham WHEREAS the Council of The Corporation of the Town of Newcastle deems it desirable to pass this by-law; . AND WHEREAS The Corporation of the Town of Newcastle purchased Parts l, 2 and 4 on Reference Plan 10R-ll45 as evidenced by a Deed registered in the Registry Office for the Registry Division of Newcastle (No. lO) on July 9, 1980 by virtue of instrument no. 99397. AND WHEREAS The Regional Municipality of Durham requires a permanent easement over the lands described in Schedule "A" attached hereto as well as a temporary easement in the lands described in Schedule "B" attached hereto; AND WHEREAS The Corporation of the Town of Newcastle has agreed to grant to The Regional Municipality of . Durham a permanent easement over the lands described in Schedule "A" as well as a temporary easement in the lands described in Schedule "B" in consideration of The Regional Municipality of Durham paying to . The corporation of the Town of Newcastle the sum of SEVEN THOUSAND, FIVE HUNDRED AND TEN--------$7,5l0.00) DOLLARSi - 2 - . AND WHEREAS it was agreed between The Regional Municipality of Durham and The Corporation of the Town of Newcastle that the temporary easement described in Schedule liB" attached hereto shall expire on March 31, 1981. NOW THEREFORE BE IT ENACTED AND IT IS HEREBY ENACTED AS A BY-LAW OF THE CORPORATION OF THE TOWN OF NEWCASTLE AS FOLLOWS: 1. The Corporation of the Town of Newcastle shall grant a permanent easement over Part 2 on Reference Plan lOR-ll45 as well as a temporary easement over Part 4, Reference Plan lOR-ll45 which temporary easement shall expire on March 31, 1981 in consideration of The Regional Municipality of Durham paying to The Corporation of the Town of Newcastle the sum of SEVEN THOUSAND, FIVE HUNDRED AND TEN-----($7,5l0.00)----DOLLARS which property is more particularly described in Schedules "A" and "B" attached. .
