THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NO.
80-117
being a by-law to authorize the
conveyance of Part l, Reference
Plan 10R-86l to The Regional
Municipality of Durham
WHEREAS the Council of The Corporation of the Town
of Newcastle deems it desirable to pass this by-law;
AND WHEREAS Council authorized the stopping up and
.
closing of those parts of Third Street and the
unnamed lane lying within Part l, lOR-861 and
authorize the conveyance of same to the abutting
owners pursuant to By-Law No. 79-146 which by-law
was registered in the Registry Office for the
Registry Division of Newcastle (No. 10) on
December 7th, 1979 as Instrument No. 97331.
AND WHEREAS the abutting owners that were entitled
to any such conveyances namely, Port Darlington
Marina Hotel Ltd., and Leroy Burk Short stated
they did not desire~_to purchase the abutting lands
and releasedtheir interest in same to The Corporation
of the Town of Newcastle.

ANDWHEREAS the property to be conveyed to The
Regional Municipality of Durham is no longer
required for the purposes it was acquired nor has
The Corporation of the Town of Newcastle any

further use for the said property.
AND WHEREAS The Regional Municipality of Durham
wishes to purchase Part 1 on Reference Plan lOR-86l
and Council has agreed to convey such property to
The Regional Municipality of Durham for the purchase
price of $l02,400.00.

NOW THEREFORE BE IT ENACTED AND IT IS HEREBY ENACTED
AS A BY-LAW OF THE CORPORATION OF THE TOWN OF NEWCASTLE
AS FOLLOWS:

All of the property designated as Part 1
on Reference plan lOR-86l shall be conveyed
to The Regional Municipality of Durham for
for the sum of $l02,400.00 which property
is more particularly described as follows:
ALL AND SINGULAR that certain parcel or tract
of land and premises situate lying and being
in the Town of Newcastle in the Regional
Municipality of Durham (formerly in the Town
of Bowmanville in the County of Durham) and
being composed of all of Block H, all of a
lane between Blocks G and H', all of Third
Street, part of Blocks Land M, and part of
Lots 1 to 9 inclusive in Block G, according to
the Smart Estate Plan (being part of Township
Lot 9, Broken Front Concession) in the former
Town of Bowmanville, now within the limits of
the Town of Newcastle, Regional Municipality of
Durham and being designated as Part 1 on a Plan
of Survey deposited in the Registry Office for the
Registry Divis.i..on of Newcastle (No. lO) as
Number lOR-86l.
Third Street and the Lane as shown on Plan 10R-86l
was stopped up and closed by The Corporation of the
Town of Newcastle by By-Law No. 79-l46 registered
in the Registry Office for the Registrv Division
of Newcastle (No. lO) on December 7, 1979 as
Instrument No. 97331.
