HomeMy WebLinkAbout74-89 ~ . e . ., AMENDEO BY AMENDEO BY BY.LAW #7.Ct:~1JlY.LAW #1.7.:?!'f?i!;, ~ CORPORATION OF THE TOWN OF NEWCASTLE BY-LA\'l NO. 74-89 being a by-law to establish certain policy and benefits for employees not covered by Union Agreement. ~lHEREAS it is deemed expedient to establish working conditions sick leave benefits, annual vacations, statutory holid~s and other benefits for the employees of the Town of Newcastle. TH~REFOHE the Council of the Corporation of the Town of Newcastle enacts as follows: ( 1) Hours of Ivork - The hours of work shall be as follows: Office Personnel - Mond~ through Frid~ 8:30 a.m. to 5 p.m. with one hour off for lunch. (2) Probation Period - Each new employee will be on a probation period of six months. (3) Pa.y Da.ys - Payment will be semi-monthly on the working d~ nearest the 15th and last working day of the month, except the p~ days for the Public Works Foremen, Superintendents and Director of Public vlorks who shall be paid bi-weekly. (4) Termination of Employment - Employment may be terminated on account of: i) resignation of employee upon 2 weeks notice ii) retirement at age of 65, 60 for Firemen iii) abolition of job or reduction of staff at the discretion of Council iv) unsatisfactory service at discretion of Council v) mental or physical diibility vfuere employment is terminated at discretion of Council, the Council shall abide by the Department of Labour Standards. The employee shall be granted sufficient reason for dismissal and allowed to speak on own behalf. (5) Medical Examination - New employees shall be subject to medical examination. (6) Employee Grievences - Salaried employees are free at any time to discuss a personal grievance with their Department Hoad. If not satisfied, they m~ ask for an interview with the Personnel Committee, and failing satisfaction, Council. ~ ,~ · By-Law No. 74- 89 (7) Employee Benefits - (a) Vacations Salaried employees will receive the following vacations: Page 2. e Employees who have completed one (1) year of continuous service will be allowed two (2) weeks vacation with pay. Employees who have completed five (5) years or more service will be aJ.lowed three (3) l:veeks vacation with pay. Employees who have completed twelve (12) or more years of service will be allowed four (4) weeks vacation pay. Employees who have completed twenty (20) or more years of service will be allowed five (5) weeks with pay. Vacation periods will be on the basis of Seniority. Vacation to be taken within the calendar year except with special permission of Council. (b) Statutory Holidays - e Days listed hereunder will be recognized as statutory holidays without loss of pay provided the employee completes the work day immediately prior to, and the d~ following the holiday unless otherwise approved by the Council. The Holidays are: New Year's Day, Boxing Day, Victoria Day, Civic Holiday, Thanksgiving Day, Good Friday, Dominion Day, Labour Day, Christmas Day, Remembrance Day and one other day during the year to be taken at the discretion of the Department Head. In the event that any of the above days fall on a Saturday or Sunday, another day shall be granted. (c) Leave of Absence - " i) Each person shall be allowed 3 days leave of absence, with pay, in the event of a death of a member of the immediate family (father, mother, brother, sister, wife, son, daughter, husband, father-in-la\'l, or mother-in-law). One day shall be allowed to attend the funeral of a brother-in-law or sister- in-law or grandparent. ii) An employee called for jury duty will be granted leave of absence with pay for the duration of such jury duty. iii) An employee will be allowed time off with pay by the Department Head for one day or part of a day for a cause or purpose which he considers appropriate. iv) Leave of Absence \dthout paY - . Leave of absence for any period without pay, shall only be granted by Council. . ~ . . . .... . By-Law No. 74-89 Page 3. (d) Pension Plan - From the date of employment, employees will be enrolled in Canada Pension Plan and the Ontario Municipal Employees Retirement System as required by Statute. (e) Hospital and Medical - The Town will pay 100% of Ontario Health Insurance Plan Premium. (f) Group Insurance - After three months employment the Town will pay 100% of the premium for Group Insurance based on one and. one hdf times salary. Drug Plan - After three months employment the Town will pay 100% of Drug Plan approved by Council, which will be the 35 cent per prescription plan. (g) Sick Leave Credit Benefits - The Town shall establish as of January 1, 1974, a system of sick leave credits as follows: An employee who has completed the probationary period of employment will be entitled to eighteen (18) days per year accummulati ve sick leave, one and one half (1~) days per month at the regular rate of pay which will be accummulative to a maximum of two hundred (200) days. No credits shall be allowed to any employee in any calendar month, who is absent from duty in that month. (i) One half (t) of the unused accum~ulated days (not to exceed two hlUldred days) will be paid to the employee upon cessation of employment after the employee has completed five years of service, but only up to maximum allowed by the Municipal Act~ (ii) If an employee dies before retirement, one half (~) of the unused accummulated days (not to exceed two hundred days) ""ill be paid to his beneficiary but only up to the maximum allowed by the Municipal Act. ( iii) v.Jhen claiming sick pay, an employee will, if required to do so, furnish a doctor's certificate after the third day of illness. (h) " THAT Section 7 (d), (e), (f) & (g) will apply only to perm- anent employees with the exception of Canada Pension Plan and Unemployment Insurance." f!# .~ ~, . . . . .. "'1' . By-Law No. 74-89 Page 4. (iv) Any employee who qualified for sick leave pay shall r~ceive full pay so long as his or her credits last. As of January 1, 1974, the following credits will be established for former employees of the Township of Darlington, the Tovmship of Clarke, Town of Bowmanville and Village of Newcastle. Townships of Darlington and Clarke - Balance at employee's credit as at December 31, 1973. Town of Bowmanville and Village of Newcastle, - 3 days credit for every year of service with a maximum credit of 30 days. (8) THIS By-Lavl will take effect on the 1st day of January 1975.
