BY-LAW NO:'. 74--61
being a by-law to establish certain
policy and benef.its for employees not
covered by Union Agreement.
tITlliREAS it is deemed expedient to establish working conditions
sick leave benefits, annual vacations, statuto~y holidays and other benefits for the
employees of the Town of Newcastle
TEl::RE}'ORE t}le Coancil of the Corporation of the Town of
Newcastle enacts as follows:
(1) Hours of Work -
The ho~~rs of work shall be as follows:
Office PersoQj,iel - l,fonday through Friday 8:30 a.m. to
5 p,m. with one hcur off for lunch.
(2) Probation Perioc

Where employoent is ter.ninated at discretion of Council, the Council shall
abide by the Department or Labour Standards. The em~loyee shall be granted
sufficient reason for dismisRel and allowed to speak on own behalf.

(6) Employee ~rievances

Salari~d c~ployee3 are free at any t~me to discuss a personal
grievance with their Department Head. If not satisfied, they
may ask for an interv:l.e-:;r ,dth ti.1e Personnel Committee, and failing 'satisfaction,
Council.

(a) Vacation$
Salaried employees will receive the following vacations:

Two weeks after one full year's service
Three weeks after five full years service
Four weeks after fourteen years service.
Salaried employees who have been in the employ of the Town
less than one year prior to July 1st, will be eligible for
vacation based on one day for each complete month worked,
with a maximum of 10 working days.
Where an employee leaves prior to the vacation period,
the employee will receive vacation payment of one-twelfth
vacation for each complete month worked from July 1st to
date of termination.
Vacation periods will be on the basis of Seniority.
Vacation to be taken within the calen~~r year except with
special permission of Council.
(b)
.Statutory Holidays
Days listed hereunder will be recognized as statutory
holidays without loss of pay provided the employee completes
the work day immediately prior to, and the day following
the holiday unless otherwise approved by the Council. The
Holidays are: New Year's Day, Victoria Day, Civic Holiday,
Thanksgiving Day, Boxing Day, Good Friday,Dominion Day,
Labour Day, Christmas Day~ Remembrance Day and one other
day during the year to be taken at the discretion of the
Department Head. In the event that any of the above days
fall on a Saturday or Sunday, another day shall be granted.
(c)
Leave of Absence
i) Each person shall be allowed 3 days leave of absence,
with pay, in the event of a death of a member of the
immediate family (father, mother, brother, sister, wife,
son~ daughter, husband, father-in-law, or mother-in-law).
One day shall be allowed to attend the funeral of a brother-
in-law or sister-in-law or grandparent.
ii) An employee called for jury duty will be granted leave
of absence with pay for the duration of such jury duty.
iii) An employee will be allowed time off with pay by the
Department Head for one day or part of a day for a cause or
purpose which he considers appropriate.
iv) Leave of Absence without pay
Leave of absence for any period without pay, shall only be
granted by Council.

(d) Pension Plan
From the date of employment, employees will be enrolled
in Canada Pension Plan and the Ontario Municipal Employees
Retirement System as required by Statute.
(e) Hospital and Medical
The Town will pay 100% of Ontario Health Insurance Plan
Premium.
(f) Group Insurance
After three months employment the Town will pay 100% of the
premium for Group Insurance based on one and one half times
salary.
Drug Plan
After three months employment the Town~ll pay 100% of Drug
Plan approved by Council
(g) Sick Leave Credit Benefits

The Town shall establish as of January 1, 1974, a system
of sick leave credits as follows:
An employee who has completed the probationary period of
employment will be entitled to eighteen (18) days per year
accummulative sick leave, one and one half (l~) days per
month at the regular rate of pay which will be accummulative
to a maximum of two hundred (200) days, No credits shall be
allowed to any employee in any calendar month, who is absent
from duty in that month.
(i) One half (~) of the unused accummulated days (not to
exceed two hundred days) will be paid to the employee upon
cessation of employment after the employee has completed
five years of service, but only up to maximum allowed by
the Municipal Act.
(ii) If an employee dies before retirement, one half (~)
of the unused accummulated days (not to exceed two hundred
days) will be paid to his beneficiary but only up to the
maximum allowed by the Municipal Act.
(iii) When claiming sick pay, an employee will, if required
to do so, furnish a dactor's certificate after the third
day of illness.

(iv) Any employee who qualified for sick leave pay
shall receive full pay so long as his or her credits
las t .
As of January 1, 1914) the following credits will be
established for former employees of the Township of
Darlington. the Township of Clarke, Town of Bowmanville
and Village of Newcastle.
Townships of Darlington and Clarke - Balance at employee's
credit as at December 31. 1973,
Town of Bowmanville and Village of Newcastle, - 3 days
credit for every year of service with a maximum credit
of 30 days.
