THE CORPORATION OF THE TOWN OF NEWCASTLE Ri~ .Y-LAw nb ;J Ilj By-Law No. 74-54 A by-law to license, regulate and govern Auctioneers. WHEREAS the Corporation of the Town of Newcastle has pursuant to The Municipal Act, R.S.O. 1970, Chapter 284, Section 381, Subsection 7, authority to enact this By-law. AND WHEREAS it is deemed expedient to license, regulate and govern auctioneers and other persons selling or putting up for sale goods, wares, merchandise or effects by public auction; NOW THEREFORE the Council of the Corporation of the Town of Newcastle enacts as follows: 1. That no person shall sell or put up for sale goods, wares, merchandise or effects by public auction within the limits of the Town of Newcastle without first having obtained a license so to do from the Council of the Corporation of the said Town of Newcastle. 2. That applications for a license under this.By-law must be submitted in writing, and approved by the By-law Enforcement Officer of the Town of Newcastle, who shall ascertain if the applicant is of good character, and whether or not the premises upon which it is proposed to sell or put up for sale said goods, wares, merchandise or effects are suitable for that purpose. 3. That a license issued under this By-law shall be valid only from the date of its issue until December 31st of the year of its issue. 4. That the fee for a license under this By-law shall be Fifty Dollars ($50.00). 5. That this By-law shall not apply to: (1) A sheriff or bailiff offering for sale by auction goods or chattels seized under an execution or a warrant to distrain for rent. (2) A resident of the Town of Newcastle disposing of his personal effects by himself. Continued...... " . . ....\' ~ ~ "" By-Law No. 74-54 Page 2 Continued..... 6. That any person committing any breach of any provision of this By-law shall be guilty of an offence and shall, upon conviction thereof, be 1 iab1e to a penalty for each such breach of not more than Three Hundred Dollars ($300.00) exclusive of costs; and any such penalty shall be recoverable under the Ontario Summary Convictions Act, and in default of payment to imprisonment in the common gool for a period not exceeding ten days, unless such fine and costs are sooner paid. 7. That all by-laws or parts of by-laws of the former Town of Bowmanville, Township of Darlington, Township of Clarke and Village of Newcastle, inconsistent with this By-law are hereby repealed.
