THE CORPORATION OF THE
TOWN OF NEl-lCASTLE
By-Law Noo 74-37
A by-latl to provide for the inspection of
plumbing and the enforcement of the
regulations respecting plumbing (Plumbing
Code) made under the Ontario Water Resources
Commission Acto
WHEREAS pursuant to the aforesaid Act, the Ontario Water Resources Commission
has, with the approval of the Lieutenant-Governor-in-Council, made regulations
published in Ontario Regulation 647/70 respecting plumbing (plumbing Code), as
amended fro~ time to time;
AND WHEREAS the Council of the Corporation of the Town of Newcastle has
been requested to provide by By-law for the appointment of an Inspector or
blspectors under the scid Act to carry out the inspections prescribed by the
said Act and Regulations and to enforce the said Act and Regulations on behalf of
the constituent municipalities of the said Corporation of the Town of Newcastle;
l~D WHEREAS the said Regulations provide that an inspection shall be made
within seven days after notification in writing to the municipality or its
authorized agents that the construction, repair, renewal or alteration is ready
for inspection>
M~D WHEREAS by the caid Regulations it is provided that where plumbing has
been constructed, repaired, rene'Vled or altered, the plumbing shall not be put
into use until it has been inspected and found to conform to the said Regulations;
AND WHEREAS by Section 64 (b) of the Ontario Hater Resources Commission Act,
RoSoOo 1972~ Chapter 1, So 70, the Council of this municipality is authorised to
pass by-laws providin3 for the inspection of plumbing and related matters;
NOW THEREFORE it is enacted by the Municipality of the Corporation of the
Town of Newcastle of the Region of Durham as a by-Ia.., of the said Corporation as
follows: -
10 This By-law shall apply to plumbing as defined in the said Regulations,
other than plumbing constructed,~repaired, renewed or altered for the
sole purpose of industrial processes, but includes the connection of
plumbing that is subject to the Regulations with plumbing that is not
subj ect to the Regulationso
2Q This By-l aw shall not apply to:-
(a) the repairing or replacement of a valve, faucent or
fixture; or
(b) the repairing of a leak or forcing out of a stoppageo

3. In this By-laltl
(a) "Inspector" merms em inspector eppoiDted or authorized by
the Council of the Corporation of the 'T'o\'m of ~\reT,'lcastle to
carry out plumbing inspections and related duties as
provided for in this by-law; and this C01illC:il hereby adopts
and rati fies any and all such appointments.
(b) "'T'reesurer" includes any person ,'"1uthorized to act on behalf
of the Treasurer or Clerk of this municipality.
h. A.YlY person who intends b;'l himself or through others to construct, repair
rene'rv or alter any plumbing in commercial, industrial or institutional
buildings or premises shall, before the commencement of such lrlOrk, produce
to the InsDector plans of the nlumbin8 that is to be constructed, repaired,
renewed or altered and of the location of drains, pipes, traps and other
\>lOrks or appliances that are or are to be part of or connected with the
plumbing, and shall pay a fee, for the inspection by the Inspector of such
nlens 2nd of such completed work, fixed in accordance with the Schedule "A"
hereto Ennexed. If additional inspections other th<m the two referred to in the
Sched1Jle are required, the person requiring such inspection shall pay in
advance a further fee for such addit.iona1 inspections, as set out in the said
Schedule "A".
5. Upon apT;roval of such plans, the Inspector shall issue a permit certifying

institution:,'1 buildings or premises, sh,'11 before the commencement of
such work, notify the Inspector of such intention, ond pay a fee for the;
insnection of such vlOrk by the Inspector in [:ccordanc~ ".-d th the schedule
hereto cmnexed.
8. No person she!ll use nor permit or cause to be used any ))lumbine; until it
has been inspected :::nd found to conform to the said Regulc:tions.
9. The Inspector is hereby appointed as an agent CDf the municipality for the
purpose of receivine; notification in writing th:,t the construction, repair,
renewe1 or alteration is ree.dy for inspection in accordance with the

12. The Treasurer shall deliver one copy of the acknowledgment to the person
paying the fee and shall forthwith deliver, or send by mail, the second
copy of the acknowledgment, to the Inspector, and shall retain the third
copy of the acknowledgment in his records.
13. Any person who contravenes this By-law is liable to a fine of not less than
FIFTY DOLLARS ($50.00) and not more than THREE HUNDRED DOLLARS ($300000)
upon summary conviction.
14. That all by-laws or portions of by-laws in the former Town of Bowmanvi11e,
Townships of Clarke and Darlington and the Village of Newcastle not
consistant with this By-law are hereby repealed.
