THE COF~ORATION OF THE TOWN OF N~WCASTLE BY-LAW NillvIBER.7.4.-.J.J A By-law to amend By-law Number 1592 being a restricted area (Zoning) By- law affecting lands formerly in the To~mshipot Clarke~ now in the Town of Newcastle WHEREAS the Municipal Council of the Corporation of the Town of Newcastle deems it advisable to amend By-law Number l592~ as 'imended. NOW THEREFORE the Municipal Council of the Corporation of the Town of Newcastle EHACTS as follows: 1. That Section 2 of By-law Number 1592 is hereby amended by inserting after subsections 11 and 25 respectively the following new subsections (lla) and (25a)~ "(lla) . (25a) "GRAVEL PEril means any open excavation made for the removal of any soil, earth, clay, marl, sand, gravel or consolidated mineral in order to supply material ~or construction, manufacturing or industrial pur~ poses~ but shall not include an excavation incid- ental to the erection of a building or structure for which a building permit has been granted by the Corporation~ or an excavation incidental to the construction of any public works. ~ , . "STONE QU.LillRY" means any open excavation made for the removal of any consolidated rock or mineral including li-.:estone ~ sandstone or shale, in order to supply material for construction, industrial, or manufacturing purposes, but shall not include an excavation incidental to the erection of a building or structure for which a building permit has been granted by the Corporation, or an excav- ation incidental to the construction of any public works." 2. That subsection 1 of Section J of By-law Number 1592 is hereby amended by inserting after the Zone and Zone Symbol for l1Industrial" the following: '. "Extractive Industrial MX" By-law No. 74-)} -2- . J. That By-law Number 1592 is hereby amended by inserting after Section 8 the following Section (8a): I "SECTION 8A - EXTRACTIVE INDUSTRIAL ZONE (I.iX:) 8A.l USES PERMITTED No person shall within any MX Zone use any lot or erect or use any building or structure for any purpose except one or more of the following uses: (a) RESIDENTIAL USES: prohibited. (b) NON-RESIDENTIAL USES: a gravel pit; a stone quarry. 8A.2 ZONE FROVISIONS No person shall within any MX Zone use any lot or erect, alter or use any building or structure except in accordance with the following provisions: . (a) RESIDENTIAL USES: not applicable. (b) NON-RESIDENTIAL USES: In accordance with the provisions of Appendix 2 hereof." 4. That appendix 2 of By-law number 1592 is hereby a~ended by inserting after Section (i) the following new Section (j)' ,,( j ) SPECIAL PROVISION - GRAVEL PITS .AND STONE QU~illRIES Notwithstanding any provisions of this By-law to the contrary, the following provisions shall apply to JYIX Zones: (i) (ii) (j -i i) Lot Frontage (MinimlliD) Lot Area (Minimum) Yard Dimensions (Minimum) for buildings, structures and pit or quarry excavation: Front Hear Side 100 feet 25 acres 100 feet 100 feet 100 feet . That Schedule "A" to By-law Number 1592 is hereby amended by changing to "I"IX" the zone symbol of the lands designated "ZONE CHANGE TO MJ(il on Schedule "N" attached hereto. . 6. This By-law shall become effective on the date ilereof, subject to receiving the approval of the Ontario Nunicipal Board. 'I'OWN OF NEWCASTLE AN EXPLANATORY NOTE TO BY-LAW NUNBER 74-)) The following is a summary and explanation of By-law Number 74-)) which amends By-law N\lmber 1592, a comprehensive Restricted Area (Zoning) By-law affecting lands formerly iT' the Township of Clarke, now in the Town of Newcastle. This By-law changes the zoning of a 70 acre parcel of land located in Lot 18, Concession 10, Township of Clark (now in the To~ of Newcastle) to an .Bxtractive Industrial "MX" category_ The By-law permits the use of the subject lands for a gravel pit or a stone quarry. . vfuile this By-law permits the subject lands to be used for extractive industrial purposes, the regulation of this use is subject to the provisions of the Pits and Quarries Control Act, 1971 and it Regulations. The above is an explanation of the provisions of the amendment to the Zoning By-law.
