THE CORPORATION OF THE MUNICIPALITY OF
CLARINGTON
BY-LAW 2007 - 149
Being a By-law to authorize a contract between the Corporation of the Municipality of
Clarington and Steven Rowe Environmental Planner, Toronto, Ontario, to enter into
an agreement for Consulting Services, Municipal Peer Review of the Durham/York
Energy From Waste Environmental Assessment Study.
THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON HEREBY
ENACTS AS FOLLOWS:
1 . THAT the Mayor and Clerk are hereby authorized to execute, on behalf of the
Corporation of the Municipality of Clarington with the Corporation Seal, a
contract between Steven Rowe Environmental Planner, Toronto, Ontario, and
said Corporation; and
2. THAT the contract attached hereto as Schedule "A" forms part of this By-law.
By-law read a first and second time this 25th day of June, 2007.
By-law read a third time and finally passed this 25th day of June, 2007.

Re: Peer Review of the York/Durham Residual Waste Study
Further to our recent discussions and my review of the Tuesday May 22, 2007 Report
#PSD-070-D7 report to your General Purpose and Administration Committee, I am
pleased to confirm my offer of services to the Municipality of Clarington in peer reviewing
aspects of the environmental assessment planning process carried out in the
York/Durham Residual Waste Study.
The York/Durham Residual Waste Study website provides access to numerous
documents prepared in support of this process, however time constraints do not permit a
detailed evaluation of the volume of material to be reviewed. Also, the proposed
assignment requires responsiveness to issues as they arise. The budget estimates
provided below are based on a broad assessment of the volume of documentation and
the level of effort that has proved to be required in undertaking similar projects.
In conducting this work I would carry out the following
• Identify documents to be reviewed that have been generated to date in
consultation with municipal staff;
• Review documents generated to date paying particular attention to:
o Consistency with the Terms of Reference and the EA Act and
Regulations
o Appropriateness and consistency of the site selection process and
methodblogies, within the parameters of the Terms of Reference;
o The approach and scope of the public consultation programme and
responsiveness to issues raised;
o Any "gaps° or inconsistencies in the process as a whole, particularly as
they relate to Clarington.
• Consult with municipal staff and other peer review team members to clarify any
issues or concerns;

• Prepare a report that documents my findings,
• Review documentation to be released when the preferred site is identified and
prepare a supplementary report, if required (budgeted separately below);
• Assist in drafting staff reports and responses;
• Review any responses prepared by the proponent in relation to Clarington's
submissions;
• Attend meetings with municipal staff, study team members, staff and consultants
of York and Durham and community representatives as required;
• Make presentations to committees and Council as required.
At my chargeable rate of $120 per hour the review of documents produced to date and
associated tasks would require an estimated budget of around $17,000, plus GST and
disbursements. If I am requested to prepare a supplementary report on the additional
documentation to be produced in support of the preferred site, this and associated tasks
(e.g. meetings, Council presentation) would require an additional $4,000.
I would bill only for time spent on the project. Given the uncertainties I would appreciate
some provision for contingency budget - or expedited budget review - if the scope or
volume of work expands significantly beyond that outlined above.
I would invoice the Municipality of Clarington at the beginning of each month for time
spent during the previous month, and my invoices are payable within 30 days.
Thank you for the opportunity to provide this service to the Municipality -contingent on
Council approval - on this interesting and important assignment. I look forward to a
productive working relationship.
