THAT Report PD-92-99 be received ; 2. THAT Council approve the request from The Kaitlin Group Limited seeking relief from the provisions of Paragraphs la) and 4b) of the Architectural Control Standards, Schedule "W' contained within the Municipality's core subdivision agreement;and 3. THAT the interested persons listed in this report and any other delegation be notified of Council's decision. 1. BACKGROUND 1.1 During negotiations with The Kaitlin Group Limited regarding the Principles of Understanding and the Subdivision Agreement with respect to the Port of Newcastle development, Kaitlin indicated a desire to seek relief from Schedule "W' of the Municipality's core subdivision agreement. 1.2 Schedule"W'to the Municipality's core Subdivision Agreement is entitled Architectural Control Standards and establishes the framework for the manner in which the dwellings are allowed to be constructed dealing with such matters as external materials,colours,elevations and styles. Kaidin is requesting relief from the provisions of Paragraph 1 a) and 4 b). Schedule "W" is attached to this Report as Attachment No. 1. a REPORT NO.: PD-92-99 PAGE 2 2. PARAGRAPH 1 a)—EXTERNAL MATERIALS 2,1 Paragraph 1 a)within Schedule"W'requires requires that all dwellings within the subdivision to which the agreement applies must be constructed with a minimum of 40%masonry products, excluding stucco and concrete blocks. The paragraph further requires that all houses situated on corner lots be constructed of 100%masonry products, excluding stucco and concrete blocks. 2.2 The Director of Planning and Development, under Paragraph 1 b) may at his discretion permit relief from the provisions of Paragraph 1 a). Relief has been granted in the past for individual lots within plans of subdivision. Inasmuch as the Kaitlin request is seeking relief from this provision for the entire Port of Newcastle development,it is staff's position that relief from the provisions of Schedule"W"cannot be obtained through the Director's discretionary power. 2.3 Kaitlin in support of their request indicated that they have always intended to develop a unique community integrating a "cape cod" style of architecture which incorporates features such as horizontal siding, porches, verandahs, turrets and balconies. It does not however incorporate the use of brick on a regular basis, although Kaitlin has advised that brick will still be used if requested by individual purchasers. Two letters submitted by Kaithn's architects justifying the , request is attached to this report as Attachments No. 2 and 3. 2.4 Part of the rationale for requiring 40% brick on all dwellings is to ensure consistency within Neighbourhoods since in most cases the land holdings that comprise the Neighbourhood are vested in the ownership of several developers. Paragraph 1 a)therefore ensures that all developers within a Neighbourhood are developing a consistent and compatible style of housing. However, in this case, Kaitlin is the sole owner of land within the Port of Newcastle Neighbourhood and intends to develop the entire Neighbourhood with a "cape cod" style of architecture which also incorporates a nautical theme. As a result, staff are supportive of Kaitlin's request. Staff would note that architectural standards for the multi-residential density and commercial blocks would be addressed through the site plan approval process when each individual Block proceeds to the development stage. PARAGRAPH 4 b)- OTHER REQUIREMENTS 3.1 This paragraph of Schedule "W' requires the developer to ensure that all dwellings carry brick veneers to within 12 inches of the grade on the front elevation and within 20 inches of the grade on the rear elevation. Exposed foundations in excess of these requirements are not permitted. Since Kaitiin is proposing to develop the subdivision with vinyl siding in accordance with the "cape cod" theme the paragraph needs to reference vinyl siding in addition to brick. The reference to brick may remain in the paragraph since Kaitiin may use brick in the construction material if so desired by the purchases. 4. RECOMMENDATIONS 4.1 The Planning and Development recommends that Council approve the request of the Kaitlin Group to allow for the revisions to Schedule "W" of the Municipality's core Subdivision Agreement as detailed within this report. EXTERNAL MATERIALS: (a) Exterior construction must be a minimum of forty (40%) percent masonry products excluding stucco and concrete blocks. Dwellings sited at the corners require full height masonry products on all elevations. (b) No substitutions are allowed within paragraph (a) except by written permission of the Director of Planning and Development. 2. COLOURS: (a) Colours of bricks, siding, roofs and trims must be compatible and in harmony such as earthtone range, pastel range, grey/black range etc. (b) Where bricks are used,coloured mortar is required. (c) Accent colour bricks for brick detailing is permitted provided if used consistently in group of dwellings. (d) Colour of caulking around metal flashing or windows is required to match colour of brick or siding. 3. REPETITION OF ELEVATIONS AND STYLES: (a) Any two (2) dwellings abutting each other must exhibit a minimum of twenty- five (25%) exterior variations in elevations or colour schedule. Georgian, Colonial, Spanish) are permitted only if constructed in a group reflecting the same architectural influence. 4. OTHERS (a) All metal roof vents and stacks must be located in the rear slope of roofs and must be painted to match the roof colour if exposed to public view. (b) All dwellings must carry brick veneers to within twelve (12) inches of the grade on front elevation and within twenty (20) inches on side and rear elevations. Exposed concrete foundation in excess of the aforementioned standard will not be permitted. (c) The Owner shall encourage the builder of dwellings to vary siting and setback of dwel l i ngs. (d) The above standards are minimum standards and builders are encouraged to' exceed the standards as long as the objective of creating attractive and aesthetically pleasing appearance is achieved. It is my understanding that the Port of Newcastle community is being developed to reflect a traditional maritime community.Architectural features that represent this theme include horizontal siding,porches,verandahs,turrets,and balconies.Our housing designs for this project have incorporated many of these features. Although municipal by-law requires the use of facebrick,I don't feel that it should be used on every house type, given the theme of the project. I trust this letter satisfies your immediate concerns. The Victorian styles, particularily Stick, Shingle and Queen Anne styles were chosen as the most appropriate. These heritage styles in a variety of vernacular forms are commonly found in lakeside locations. The exterior cladding of this the Stick and Shingle style of architecture is exclusively horizontal wood siding with a variety of secondary materials including wood shingles and decorative wood trim, The units proposed for the Port of Newcastle reflect these architectural styles.
