Report #: PD-87-99 FILE #: ZBA 99-016 By-law# 99-�10 Subject: REZONING APPLICATION (REMOVAL OF HOLDING SYMBOL) APPLICANT: LAWRENCE WESSON ON BEHALF OF SCHICKEDANZ BROS. LTD. PART LOT 9, CONCESSION 2, FORMER TOWN OF BOWMANVILLE BRADSHAW STREET, BOWMANVILLE FILE: ZBA 99-016 Recommendations: It is respectfully recommended to Council the following: 1. THAT Report PD-87-99 be received; 2. THAT the request submitted by Lawrence Wesson on behalf of Schickedanz Bros. Ltd. for removal of the Holding (H) symbol from the subject lands be APPROVED and that the amending By-law attached hereto be forwarded to Council for approval; 3. THAT a copy of this report and the attached Amendment be forwarded to the Region of Durham Planning Department; 4. THAT the attached Amendment be circulated in accordance with the regulations made under the Planning Act; and S. THAT all interested parties listed in this report and any delegation be advised of Council's decision. 1. BACKGROUND 1.1; Land Division applications LD 118/99, LD 119/99 and LD 120/99 are located in Part tot 9, Concession 2, former Town of Bowmanville. The removal 'of the Holding (H) symbol is a condition for the completion of the three applications. t REPORT NO.:PD-87-99 PAGE 2 1.2 Staff are satisfied that the applicant will complete the conditions of the severance approvals in an expeditious manner. Staff does, through the execution of a Land Division Development Agreement, have the mechanism to ensure that all conditions are fulfilled before the clearance letter is sent to the Land Division Committee and as such would have no objection to the removal of the (H) Holding symbol. 2. STAFF COMMENTS 2.1 Staff advise that the Holding (H) symbol may be removed upon Council being satisfied that the uses to be permitted will be adequately serviced, have adequate access and will be used for purposes intended by the By-law. In reviewing the proposal, Staff is satisfied that the conditions required for the removal of holding have been met. 2.2 Given the above comments, Staff would have no objection to the removal of the Holding (H) symbol as illustrated in the attached By-law (see Attachment#3). J THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON BY-LAW NO. 99- being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law for the Corporation of the former Town of Newcastle WHEREAS, the Council of the Corporation of the Municipality of Clarington deems it advisable to amend By-law 84-63, as amended, of the Corporation of the former Town of Newcastle to implement ZBA 99-016; NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Municipality of Clarington enacts as follows: 1. Schedule "3"to By-law 8463, as amended, is hereby further amended by changing the zone category from: "Holding — Urban Residential Exception ((H)R2-22)" to "Urban Residential Exception (R2-22)Zone, as illustrated on the attached Schedule "A" hereto. 2. Schedule"A"attached hereto shall form part of this By-law. 3. This By-law shall come into effect on the date of the passing hereof, subject to the provisions of Sections 34 and 36 of the Planning Act. BY-LAW read a first time this 19'day of July, 1999.
