HomeMy WebLinkAboutWD-17-99 , THE CORPORATION OF THE MUNICIPALITY OF CLARlNGTON Meeting: REPORT GENERAL PURPOSE AND ADMINISTRATION COMMITTEE File # IJ\'C-CC Date: MARCH 29,1999 Res. #G.pf-l - 13'1-,/ By-Law # ff~/f5 Report No.: WD-17-99 Subject: COURTICE CROSSING SUBDIVISION, PHASE 3, PLAN 40M-1815, COURTICE 'CERTIFICATE OF ACCEPTANCE' AND 'ASSUMPTION BY-LAW', FINAL WORKS INCLUDING ROADS AND OTHER RELATED WORKS Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report WD-17 -99 be received; 2. THAT the Director of Public Works be authorized to issue a 'Certificate of Acceptance' for the Final Works, which include final stage roads and other related Works, constructed withinPlan40M-1815; and 3. THAT Council approve the by-law attached to Report WD-17-99, assuming the streets within Plan 40M-1815 as Public Highways. REPORT 1.0 ATTACHMENTS No.1: Key Map No.2: Road Dedication By-law 2.0 BACKGROUND 2.1 The Corporation of the Municipality of Clarington entered into a Subdivision Agreement, registered November 23, 1993, with 290572 ONTARIO LlMlTED to develop lands by plan of subdivision, located in Courtice and described as Plan 40M-1815 (Attachment No. I). 1106 REPORT NO.: WD-17-99 PAGE 2 The agreement required the developer to construct all roadworks, including hot-mix paving, sidewalks, cwb and gutter, street trees, a storm drainage system and street lights, hereinafter referred to as the 'Works'. 2.2 The standard subdivision agreement provides for the separation of the Works into four (4) stages: (a) Initial Works; (b) Street Lighting System; (c) Final Works; and (d) Stormwater Management Facility (Not Applicable) 2.3 The Initial Works and Street Lighting System Works were issued 'Certificates of Completion' and subsequent 'Certificates of Acceptance' by the Director of Public Works, as per the maintenance requirements set out in the Subdivision Agreement. 2.4 The Final Works were issued a 'Certificate of Completion' dated November 3, 1997. This initiated a one (I) year maintenance period which expired on November 3, 1998. The Works have been reinspected and all deficiencies have now been rectified to the satisfaction of the Director of Public Works. 2.5 It is now appropriate to issue a 'Certificate of Acceptance' for the Final Works. The subdivision agreement requires Council approval prior to the issuance of any 'Acceptance Certificate' for Final Works. 2.6 Further to the issuance of a 'Certificate of Acceptance', a by-law is required to permit the Municipality to assume certain streets within Plan 40M-1815 as public highway (Attachment No.2). 1107 ,j~ REPORT NO.: WD-17-99 PAGE 3 Respectfully submitted, Reviewed by, ~~ Stephen A. NOW THEREFORE, the Council of The Corporation of the Municipality of Clarington enacts as follows: I. THAT the laods described as Block 37, Plao 40M-1815, in the Municipality of Clarington, Regional Municipality of Durham, are hereby established, laid out, dedicated as public highway aod assumed by the said Corporation for public use. 2. THAT the streets shown on Plao 40M-1815 aod listed below in this section, all being in the Municipality of Clarington, in the Regional Municipality of Durham, are hereby accepted by the Corporation of the Municipality of Clarington as public highways, aod assumed by the said Corporation for public use: Avondale Drive Short Crescent Saodringham Drive BY-LAW read a first aod second time this 13th day of April, 1999.
