RECOMMENDATIONS:
It is respectfully recommended to Council the following:
1. THAT Report TR-50-99 be received;
2. THAT Dagmar Construction Inc., Markham, Ontario, with a total bid in the amount of
$982,580.54 (including G.S.T.), being the lowest responsible bidder meeting all tenms,
conditions and specifications of Tender CL99-8, be awarded the contract for the
construction of Westside Creek Bridge and Cove Road as required by the Department of
Public Works;
3. THAT the total funds required in the amount of $632,200.00 ($982,500.54 + design,
contract administration and utilities less Blue Circle Contribution) for the Municipality of
Clarington portion be drawn from the Public Works Account #7205-97006-0261; and
4. THAT the costs attributable to Blue Circle Canada Inc. be interim financed from working
Funds Reserve Account # 2900-00001-0000;
5. THAT expropriation up to the budget limit for legal consulting and other related costs of
$59,600.00 be charged to the Public Works Capital Account for Cove Road and any further
costs up to $53,717.00 be charged to the General Capital Reserve account #2900-00017-
0000 as necessary.
6. THAT the attached By-law marked Schedule "A" authorizing the Mayor and Clerk to
execute the agreement be approved;
BACKGROUND AND COMMENT
Tender specifications were provided by Totten Sims Hubicki Associates for the construction of
Westside Creek Bridge and Cove Road, as required by the Department of Public Works.
Tenders were advertised in the local papers, as well as the Daily Commercial News.
Subsequently, tenders were received and tabulated as per Schedule "B" attached.

The Municipality of Clarington's portion of the total project cost, including Project Administration, as
detailed in the letter from Totten Sims Hubicki Associates, marked Schedule "C" is estimated at
$632,200.00. Included in the total tendered price of $982,580.54 is work to be funded jointly
between the Municipality of Clarington and Blue Circle Canada Inc., as outlined in the Principles of
understanding dated November 3, 1997. Pursuant to the Principles of Understanding, the
contribution from Blue Circle Canada Inc. will not be received until the Closing Date as defined in
the Principles. This is anticipated to be in Late November 1999. In the interim, the costs
attributable to Blue Circle Canada Inc. will need to beinterim financed.
The required funds will be drawn from the Public Works Account #7205-97006-0261, as identified
on Page 188 ofthe 1999 Capital Budget, and are within the budget allocation of $691 ,800.00.
The low bidder has not performed for the Municipality of Clarington in recent years, however they
have provided satisfactory service for other Municipalities including the Region of Durham.
There have been significant costs attributable to the development of the Principles of
Understanding and the expropriation process incurred to date. For 1999, costs to date for legal
and consulting relating to the expropriation total approximately $17,500.00. As the capital project
is anticipated to be under budget by $59,600.00, it is recommended that the legal and consulting
costs up to this amount be charged to the public works capital account for Cove Road. As
identified in the 1998 Year End Transfer Report TR-35-99, $53,717.00 has been transferred into
the General Capital Reserve from unexpended 1998 pre-engineering budget for Cove Road
related costs. It is proposed that costs exceeding the public works capital budget then be charged
to General Capital Reserve. Should formal arbitration proceedings commence, a separate Report
will be forthcoming to Council from the Municipal Solicitor to address the legal process and any
potential associated costs.
The Treasurer has reviewed the funding requirements and concurs with the recommendation.
Queries with respect to department needs, specifications, etc, should be referred to the Director of
Public Works.

After further review and analysis of the bids by Public Works, Totten Sims Hubicki Associates and
Purchasing, it was mutually agreed that the low bidder, Dagmar Construction Inc., Markham,
Ontario, be recommended for the contract for the construction of Westside Creek Bridge and
Cove Road Construction.

BY-LAW 99-
Being a By-law to authorize a contract between the
Corporation of the Municipality of Clarington and
Dagmar Construction, Markham, Ontario, for
the construction of Westside Creek Bridge and Cove Road.
THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON
HEREBY ENACTS AS FOllOWS:
1. THAT the Mayor and Clerk are hereby authorized to execute, on
behalf of the Corporation of the Municipality of Clarington with the
Corporation Seal, a contract between Westside Creek Bridge and
Cove Road., and said Corporation; and
2. THAT the contract attached hereto as Schedule "A" form part of this
By-law.

The low bidder's tender has been reviewed and is in order. Dagmar Construction has not compleled any
work for the Municipality of Clarington in recent years. They have, however, worked for other
municipalities including the Region of Durham. All references eomacted judged Dagmar's performance to
be average to above averag~. We, therefore, recommend acceptance of their low bid.
A sununary of cSlimated project costs is attached for your reference. The summary exclude,~ all cost
relating to land acqui,ition and the expropriation proce's.
The project is to be funded jointly between the Municipality and Blue Circle Canada Inc, Pinondal derails
are outlined in the Principles of Understanding dated November 3, 1997. Schedule "I" from the document
detailing estimated construction cost, is attached for your ease of reference. Engineering and construction
COSIS incurred to date and estimated based 011 Dagmar's tender are within the budget detailed on Schedule I.
