It is respectfully recommended:
1. THAT Report CD-47-99 be received; and
2. THAT the vicious dog declarations served on Patricia Roberts be upheld.
BACKGROUND AND COMMENT
On October 26, 1999, the Animal Services Officers investigated a complaint in Courtice wherein two small
dogs were attacked by two Chow dogs. The previous day (October 25, 1999) at approximately 5:00 p.m.,
a 5-year-old Shih Tzu (Tasha) was on her driveway when the two Chows attacked, pulling and shaking
her. Tasha's owner and her son were unable to break up the attack until a neighbour assisted. Once they
had her in the house, the Chows attacked the other dog, a Lhasa-Apso named Kora. Kora managed to
escape and ran into the house. One of the Chows was still in pursuit and attempted to enter the open
doorway.
As a result of this attack, the Lhasa-Apso received a punctured muscle and was released from the vet the
same evening. Tasha, the Shih Tzu, however, was hospitalized ovemight to stabilize her condition and
surgery was performed the next morning. She required approximately 40 stitches, was heavily medicated
and had three drain tubes inserted into her body. The total vet bill amounted to $1,078. 26. The owner
received minor injuries to her left hand during the attack.
Upon investigation of this incident, both of the Chows were quarantined by the Durham Regional Health
Department.
The Animal Services Officer has reported that at approximately 5:00 p.m. on October 25, 1999, a call was
received from another resident in the neighbourhood to report thatlwo Chows were in his backyard and
had attacked his Scottish Terrior. He witnessed the attack and was able to break it up, but the dogs ran
away. The Officer also reports that these Chows have been returned home on at least one occasion when
they have been found to be running at large. They were last licenced in 1997.

Following investigation of the October 25 incident, the Animal Services Officer issued two declarations of
vicious dog to Patricia Roberts. These declarations require the owner of the vicious dogs to:
1. licence and register the dogs with the Clarington Animal Shelter and have the dogs permanently
identified by microchip implantation, at her expense, within 21 days of receipt of the Declarations.
Proof of such registration must be provided to the Animal Services Division within 30 days;
2. notify Clarington Animal Shelter immediately upon relocating the dogs or upon transferring
ownership of the dogs;
3. restrain the dogs at all times, while the dogs are on their own property, by keeping them enclosed
in a pen or other enclosure in such a manner as to prevent the dogs from leaving the property and
to prevent contact with people and other animals;
4. restrain the dogs at all times, while the dogs are off their own property, with the use of a muzzle
and a leash no longer than 6 feet and under the care and control of a person who is 16 years of
age or older.
Ms. Roberts was advised that these declarations could be appealed to the Council and she has indicated
her wish to do so. Accordingly, Ms. Roberts will be addressing Council with respect to this matter on
November 22,1999.
It is staffs recommendation that the vicious dog declarations be upheld.
