THAT Report CD-46-99 be received; 2. THAT the request received from Beverly Jeeves to hold a New Years' Eve Party in the Andrew Street Parkette on December 31, 1999, be approved, with the exception of the holding of an open-pit fire; 3. THAT an exemption to Section 2. (1) of By-law 92-160 be granted to Beverly Jeeves to allow for a fireworks display to be held on December 31, 1999 in the Andrew Street Parkette; 4. THAT any additional lighting in the parkette be set up at the organizers' cost and all clean up be completed to the satisfaction of the Director of Public Works; and 5. THAT Beverly Jeeves be advised of Council's decision. REPORT: At the General Purpose and Administration Committee meeting held on November 1, 1999, correspondence from Beverly Jeeves requesting permission to hold a New Years' Eve party in the Andrew Street Parkette was referred to staff for comment. Ms. Jeeves indicated that the party would be held from 7:00 p.m. to 8:30 p.m. She would like to include a fireworks display at 8:30 p.m., serve hot dogs and hot chocolate, set up lighting for the park, permission for the adults to consume minimal amounts of alcohol and have an open-pit fire. In order to address her request, various agencies were contacted, as follows: Alcohol and GaminQ Commission The organizers will need to apply for a Special Events Permit to allow for alcohol to be served. It is staffs understanding that the licenced area will need to be fenced off from the general areas of the park, however, there should not be any problem with receiving a licence, provided the application is submitted to the local LCBO 30 days prior to the event. < . . . Report CD-46-99 - 2- November 8, 1999 Durham ReQional Police Deoartment Ross Smith, Inspector, Durham Regional Police Department has indicated that the Police Department have no concerns with the event as it relates to policing issues. Public Works Deoartment Ms. Jeeves has requested lighting be set up in the parkelle. There is a street light strategically placed to benefit the parkelle, however, if the organizers wish to erect additional lighting at their cost, the Public Works Department has no problem with them doing so. The Public Works Qepartment has specified that the clean up, which the organizers realize they are responsible for, is to be done to the satisfaction of the Director. Fire Department The Fire Chief has stated that he cannot approve the request for an open-pit fire in this area as it is in contravention of the Municipality's by-law and would set a dangerous precedent. The Chief has indicated that he has no problem with the organizers of the event having a fireworks display in the area, provided they are set off by or under the supervision of a person or persons at least 21 years of age. The Municipality's' fireworks by-law allows for the selling off of fireworks only around Victoria Day and Canada Day, and then only on property owned by or leased to the person selling off the fireworks. It will be necessary, therefore, for Council to approve an exemption to that section of the by-law in order for the fireworks display to take place. Recommendations Given the comments of the various departments and agencies, it is recommended that Council approve the request to hoid the New Year's Eve Party in the Andrew Street Parkelle as applied for, with the exception of the open-pit fire.
