THE CORPORATION OF THE MUNICIPALnY OF CLARINGTON REPORT Date: Monday, October 4, 1999 File # ~ Res. #(;//1/40 -'11 Meeting: General Purpose and Administration Committee Report No. CD-37-99 By-law #_ Subject: AMENDMENTS TO SKATEBOARD AND BICYCLE BY-LAW It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report CD-37-99 be received; and 2. THAT the amendment to By-law 89-107 to prohibit skateboards and bicycles interfering with the movement of traffic, attached to Report CD-37-99, be approved. BACKGROUND: Staff have received complaints from citizens concerning problems with individuals operating skateboards and bicycles in such a manner as to interfere with vehicular traffic movement on the streets. These issues have been referred to the Durham Regional Police for their action. The Regional Police have requested amendments to the current Skateboard and Bicycle By-law in order to assist them in dealing with this matter. Staff have discussed this matter with the Regional Police. The proposed amendment is intended to address their concerns. The proposed amendment will not act so as to prohibit skateboards and bicycles on the road, it will only regulate their activity. The amendment will also correct a deficiency in the By-law's penalty provisions. RECOMMENDATIONS: It is therefore recommended that the amendments be approved and passed. Chief Administrative Officer !J2 . ., THE CORPORATION OF THE MUNICIPALITY OF ClARINGTON BY-lAW 99- Being a By-law to amend the Skateboard and Bicycle By-law WHEREAS the Council of the Corporation of the Municipality of Clarington deems it necessary to amend By-iaw 89-107 regulating the use of bicycles and skateboards; NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Municipality of Ciarington enacts as follows: 1. Section 4 is repealed in its entirety and replaced with the following: 4. No person shall ride a skateboard or bicycle on any public street in a manner likely to interfere with the movement of traffic. 5. Every person who contravenes any provision of this by-law is guilty of an offence and liable to a fine on conviction as provided for in the Provincial Offences Act. 2. This By-law shall come into full force and effect on the date of its final passage.
