THAT the minutes of a regular meeting of Council held on
January 27, 2003, be approved.

Mayor Mutton advised that this Saturday, February 15, 2003, he will
be travelling to Russia along with Regional Chair Roger Anderson
for the eighth set of negotiations regarding the hosting of Iter.
Mayor Mullon is looking forward to meeting the American and
Chinese counterparts. He stated that there is a very good article in
the Toronto Star on page A6 regarding Iter.
Regional Chair Roger Anderson appeared before Council to
update them on Regional issues. He congratulated Council on their
10th anniversary of using the name, Municipality of Clarington,
which was selected by its residents. Looking back over the past
year, there were some noteworthy successes in 2002:

national awards for planning pertaining to the work with York
and Peel Regions on the Oak Ridges Moraine Strategy;
several Economic Development awards initiatives ego
Building Business Together CD-ROM, website and the Farm
Fresh Map;
participation in the Iter program and exchange;
waste management agreement with Clarington, Scugog,
Brock and Uxbridge;
opening of the new 300-bed facility named Hillsdale Estates;
phase 2, a new 200-bed facility named Hillsdale Terraces
will commence construction this spring;
Social Services Department was rewarded by the Province
for surpassing the Ontario Works placement targets with
$666,000 in Community Participation bonuses. The bonus
funds were applied to a variety of services from
homelessness to child nutrition programs;

. non-smoking by-law generated a lot of citizen interest and
input;
. Council decided to help fund the new Regional Cancer
Centre;
. Regional Headquarters proposal has been hotly debated;
. New provincial legislation ego Safe Drinking Water Act and
the Nutrient Management Act;
. established an Accessibility Advisory Committee under the
new Ontarians with Disabilities Act;
. working on achieving an integrated region-wide transit
system;
. leading a GTA Task Force to recommend reforms to the
Ontario Municipal Board;
. 2003 regional budget process should conclude by mid
March; and
. new Family Services Durham office opened for business on
February 3' 2003, at 234 King Street East, Bowmanville.
Mr. Anderson explained to Council the reasons why the Region
needs a new headquarters. Regional staff met with Enid Slack
working on behalf of the Municipality of Clarington and answered all
her questions.
By 2020, Mr. Anderson expects that Durham's population will
almost double bringing them close to 1 million residents. In the
past year alone there has been 4700 new homes region wide.
Clarington is one of the fastest growing municipalities with growth
of more than 15% in the pastS years. While growth increases our
tax base, it also adds to service demands. Gelling the
infrastructure built to keep up with that growth will be a major
challenge for Durham in the coming years. Some of the critical
pieces, like the 407, 401 interchanges or extension of GO Train
service are not within their control.
Capital expenditures that are planned for Clarington are as follows:

Courtice Water Pollution Control Plant;
Expansion of the North Street pumping station and
forcemain;
Watermain extension into Luverme and Munday Courts;
Reconstruction of Bloor Streel/Townline intersection;
Environmental assessment work for the Adelaide Avenue
extension;
Design for future reconstruction of Mill Street;

. Pavement rehabilitation will be done in various locations;
and
. Pedestrian signals will be installed at two locations on
Liberty Street, near the High School and at Victoria Street.
2003 could be the most exciting year the Region of Durham has
seen yet. The recent addition of the United States to the Iter
equation is extremely positive for the Canadian bid. We have
growth, we have the new university preparing to welcome its first
students, we have communities, like Clarington, with character and
drive as the foundation for a dynamic future in Durham.
Allan Hewitt, Chair, Samuel Wilmot Nature Area Management
Advisory Commillee, provided Council with a status report. The
Committee was established in 1998 as a Committee of Council.
The Samuel Wilmot Nature Area is comprised of 77 hectares of
land which is considered the best for fishing, hiking and walking.
Last year they installing 25 bird and bat houses, conducted two
nature hikes and a scavenger hunt, operated a public awareness
booth and opened a 25 car parking area on Toronto Street. In
December they received a donation of five mature trees. Their
plans for 2003 include:
. Annual Earth Day celebrations in April;
. new trail at Baldwin Meadow;
. new viewing platform
. stream bank stabilization; and
. Ontario Power Generation funding is being investigated to
create a memorial area to the Lovekin family.
The Samuel Wilmot Nature Area would make an excellent outdoor
education centre in the future. Mr. Hewillthanked Council for their
support over the year.
Suzanne McCrimmon, Clarington Board of Trade, presented a
power point presentation to Council regarding the Clarington Board
of Trade's Business Retention and Expansion Program. The
presentation highlighted the following:

what are the benefits of a Business Retention and

Jerry Hasiuk, Hasiuk Trailers Ltd., Box 722, Colbourne, KOK 1 SO,
appeared before Council requesting an entrance to his property at
Baseline and Hancock Roads. Mr. Hasiuk has a trailer leasing and
container storage company located on a 100-acre piece of land
located at Baseline and Hancock Roads. The reason he was
interested in this property is because it was zoned M2. Mr. Hasiuk
received a letter on December 20, 2002, from the Planning
Department requesting a 3 metre high berm to continue along
Baseline Road, 2% parkland dedication and, should land be
needed for any road widenings, the municipality would like the land
free and clear. Mr. Hasiuk advised Council that everything they
are asking for will cost him $180,000. He took pictures along the
entire Baseline Road and found no berms and he is wondering why
he is being singled out.
Councillor Schell stated a pecuniary interest with respect to the
delegations of Glen Cartwright and Glenda Gies, refrained from
discussion and voting on the subject matter. Councillor Schell's
employer is St. Mary's Cement who are the owners of the subject
property.
Glen Cartwright, Habitat Works, 2099 Embleton Road, Huttonville,
LOS 1 BO, circulated to Council an overview of the dredging
operations to take place at the Westside March and their rationale
for completing the work before the first of April. Mr. Cartwright
stated that they do not have any accurate data concerning absolute
noise levels of the equipment. They anticipate this activity to be
relatively quiet when compared to other construction activities. The
hydraulic dredge operates on a diesel engine mounted on a barge
and would produce similar quantities of noise as a truck running.
Other noise sources include drilling and the release of the spoils.
The drilling noise will be attenuated by its subsurface nature and
the area of spoil deposition is farther away from the residential
dwellings (at the far north end of the marsh). Mr. Cartwright is
seeking an exception to the noise by-law to allow for the work to be
ongoing 24 hours/day.

Glenda Gies, 311 Cove Road, Bowmanville, L 1 C 3K3, appeared
before Council representing the Port Darlington Community
Advisory Commillee. Ms. Gies advised Council that the Committee
were only advised of the dredging operation a week ago and noted
that an information session has been scheduled for February 12,
2003, from 7:00 p.m. to 9:00 p.m. at the St. Mary's Cement
Technical Centre. She noted that the Committee has not had an
opportunity to share information with the residents of the area or to
hear their concerns. Ms. Gies is requesting Council to defer
consideration of the noise by-law exemption so they may meet with
Mr. Cartwright.
James Garrow, 2033 Concession 6, Hampton, LOB 1JO, appeared
before Council regarding Report CLD-07-03 - Order to Restrain.
Mr. Garrow advised Council that his dog has been accused of
killing a cat. He noted that he has a witness report placing his dog
at the witness' side at the time of the attack. Mr. Garrow believes
that residents of the area are tired of dogs running at large and
perhaps there was no incident or that the incident occurred but it
was not his dog. Mr. Garrow has heard that a white dog was seen
carrying the cat and no one was seen the white dog since. He
stated that his dog is a bull mastiff and perhaps people are
uncomfortable with the dog because of its size.
Dennis Park, 1946 Concession Road 6, RR #1, Hampton,
LOB 1JO, appeared before Council regarding Report CLD-07-03-
Order to Restrain. Mr. Park stated that his cat was found in a ditch
severely mauled. He stated that his neighbour identified Mr.
Garrow's dog as being the dog that attacked the cat and
questioned if Mr. Garrow's dog is allowed to run free will this
happen again?
Libby Racansky, 3200 Hancock Road, Courtice, L 1 E 2M1,
appeared before Council to advise that Hydro One is allowed to use
Garlon 4E along hydro lines after cutting and shredding of some
trees and shrubs. Hydro One says that they have to use it to get rid
of undesirable vegetation below and around hydro lines to reduce
maintenance needs. Ms. Racansky was told by the Ministry of the
Environment that it is an appropriate time of the year to do
treatments in wet areas because most of the water will be frozen
and contamination from leaching and/or run-off will be less likely to
occur and that the sunlight will help to breakdown the vegetation.

Unfortunately, with the latest unpredictable weather, it rained the
night after Garlon application was used. It was probably washed
out into our local streams and eventually into Lake Ontario, our
municipal water supply. Garlon 4E is highly toxic to fish and inhibits
behaviour in frogs that help them to avoid predators. It is not
labelled for application to water surfaces. Ms. Racansky is
questioning whether Council approves the use of Garlon in
Clarington.

meeting dated December 19, 2002.

B. Taylor, City Clerk, City of Pickering, writing to the Region of
Durham advising that the City of Pickering on January 20, 2003,
passed the following resolution:
"WHEREAS the City of Pickering represents approximately
twenty percent of the assessment of the Region of Durham;
and
WHEREAS the City of Pickering taxpayers share in the cost
of Region of Durham expenditures through the apportioned
tax levy; and
WHEREAS the Region of Durham Council has a
responsibility to be accountable to the taxpayers of
Pickering; and
WHEREAS the Council of the City of Pickering realizes its'
responsibility to exercise due diligence on behalf of it's
constituents; and
WHERES there has been limited information provided either
to the City of Pickering Council and the local taxpayers
regarding the proposed new Regional Headquarters; and
WHEREAS there have been substantive changes to the
reports issued to date at the Region which has resulted in
some confusion; and

NOW THEREFORE be it resolved the Council of the City
Pickering requests Durham Region Council defer any
decision regarding the construction of a new Regional
Headquarters until all the local Durham Municipalities have
been provided with all reports and detailed documents
supporting any business case analysis; and
THAT the local Municipalities be given sufficient time for
local review, public input and comment back to Regional
Council; and
THAT this motion be circulated to the Councils of all Durham
Municipalities and all Durham MPPs,"

Strand, Fisheries and Oceans Canada, advising that the Region of
Durham on January 22, 2003, passed the following resolution:
"a) THAT the Region execute a Letter of Intent

Commissioner of Works) with the Department of
Fisheries and Oceans to implement compensation,
mitigation and monitoring measures for the alteration
and disruption of fish habitat in a tributary of Harmony
Creek Branch 4, south of Taunton Road (Regional
Road 4) and east of Townline Road (Regional Road
55), in the Municipality of Clarington, and in the West
Corbett Creek at its crossing of Consumers Drive
(Regional Road 25), west of Thickson Road (Regional
Road 26), in the Town of Whitby;

Alderman John Schmal, President, Federation of Canadian
Municipalities (FCM), advising Council that FCM recently attended
the Executive Committee Meeting of the International Union of
Local Authorities (IULA) held in Tunis. This was an historic meeting
since decisions taken there are leading to the amalgamation of
IULA and the Federation Mondiale des Cites Unies/United Towns
Organization (FMCU/UTO). This new, single, unified international
voice for municipal governments will more effectively represent
municipal issues within the international community of the United
Nations, World Bank, and other conferences and forums. The new
organization, tentatively named the World Organization of United
Cities and Local Governments, will have the size, financial stability
and mandate to be an influence on the world stage where
individually the two previous organizations did not. The new
organization will begin operations out of its new facility in
Barcelona, Spain on January 1, 2004.

John O'Toole, MPP, Durham, advising Council that he is confident
that Clarington's support for the County of Essex resolution
regarding the Nutrient Management Act and the Province of Ontario
Opportunity Bonds will be of assistance in encouraging the federal
government to work cooperatively with the Province as a partner in
ensuing all communities have modern and efficient public
infrastructure.

Council for supporting the Juno Beach Memorial Education Centre.
Clarington inscribed bricks will now be placed with all the Durham
municipal bricks. The decision to purchase two bricks means the
name of Clarington will also be placed on the supporters' wall which
will be located in the lobby of the Centre as well as on the Juno
Beach Centre web site.

Government of Ontario Press Release, advising that the Ernie Eves
government has appointed the Honourable George W. Adams, QC,
to conduct talks with fire services stakeholder groups and review
the use of full-time firefighters who also serve as volunteer
firefighters or other emergency response personnel. Because 95
percent of Ontario communities rely on volunteer firefighters to
augment or provide fire suppression services to their residents, full-
time firefighters also serve in other communities as volunteer
firefighters or other emergency response personnel. As a result, a
number of 'two-hatter' firefighters are at risk of being expelled from
their associations and losing their jobs.

Ministry of Tourism and Recreation, advising Council that the Ernie
Eves government is establishing a new delivery model and
investing up to $6.8 million to enhance northern tourism marketing
efforts. The new model integrates northern tourism marketing with
the Ontario Tourism Marketing Partnership Corporation, the
government's tourism marketing agency.

Kevin Gaskin, Advanced Care Paramedic, President, Durham
Paramedic Association, writing to Mr. Art Short, President,
Bowmanville Lions Club regarding their purchase of a Public
Access Defibrillator (PAD) to be located at the Beech Centre, Mr.
Gaskin commends the Bowmanville Lions Club for their actions and
their commitment to the PAD program in Durham Region. It is
proven when someone suffers a cardiac arrest, the sooner the
heart can receive an electrical shock the more beneficial it will be.

THAT the Regional Health Department be requested to make a
presentation to Council regarding the West Nile Virus,
"CARRIED"
Federation of Canadian Municipalities (FCM), advising Council that
on December 7, 2002, the Federal Court of Appeal upheld the
decision of the Canadian Radio-television and Telecommunications
Commission (CRTC) that there are no conslitutionallimits on its
power to impose all of the conditions under which
telecommunications companies may gain access to and use
municipal rights-of-way for their transmission lines, However, the
Court was divided with respect to how the CRTC dealt with the
issue of compensation for the use of municipal lands, FCM is
concerned about the implications of the ruling in relation to the right
of municipal governments to manage public lands and to receive
fair compensation for their use by telecommunications companies.

John Shewchuk, Sales Representative, Industrial Commercial
Investment, advising Council that he was discouraged to read
about the future development freeze for East Bowmanville Main
Central Area. Mr. Shewchuk agrees that there is a traffic problem
in Bowmanville but this problem is certainly not restricted to this
East Bowmanville Area nor caused by it. Traffic is certainly
problematic throughout the whole downtown core and is quite
clearly a result of the residential growth Bowmanville has
experienced over the last year. It is unfortunate that the effects of
such growth over the last 4 years could not have been better
foreseen from the number of applications for building permit
approvals and such traffic issues anticipated. It is unfair to the
business community and residents in the East Main Central Area to
shoulder this problem in this way. It is unfair to the applicants who
have invested considerable time and monetary resources to bring
forth their proposals.

have been brought to his attention regarding the speed of traffic on
the ih Concession at Tyrone.

Audrey Willson, requesting Council's permission to hold the Yellow
Fish Program in Newcastle Village on May 3, 2003. Girls aged 5
years to 15 years will be painting yellow fish on curbs where drains
are located. The girls will also be handing out leaflets to each door.
Ms. Willson advises that roads will not need to be closed off but she
would like to request the use of curbs and two feet of the streets.
She would also like to request the use of pylons and vests for the
girls to wear while painting.

Doug Cavanaugh, President, Durham Regional Police Association,
advising Council of one of the foremost issues plaguing their
Association, inadequacy of the courts within the Durham Region.
With several court locations to staff, insufficient and unsafe holding
facilities for accused persons, the justice system has become
unjust for all. There have been incidents of escapes by high risk
and youthful offenders in the past directly related to the court
facilities. There is now a situation that has forced this Police
Service to house institutionalized persons within the holding cells of
their police stations while awaiting transportation to the courts, This
procedure is inappropriate if not illegal. This Association has met
with local and Provincial politicians demanding immediate action for
a new and adequate court facility, An immediate commitment from
the Province of Ontario to begin construction is demanded.

Jack Cox, President, Ontario Senior Games Association, providing
Council with a copy of the Bid Guidelines for the Ontario Senior
Games - Winterfest 2005. Mr. Cox is inviting the Municipality of
Clarington to apply as the host of the 2005 Ontario Senior Games -
Provincial Championships. The Winterfest Games are held every
two years and are the highest profile winter multi-event competition
for seniors in Ontario. The deadline for receipt of a 'Letter of Intent'
is February 21, 2003 and the deadline for receipt of bid proposal
applications is March 31, 2003.

Grant Process

Ontario Power Generation will partner with the Visual Arts Centre
pertaining to Art in the Atrium.
The following Winterbreak activities are scheduled:
. Signs of Spring;
. Maple Taffy Fun; and
. Friday Movie Mania.
Councillor Rowe advised Council of the official open of the Art in
the Atrium exhibit on Friday, February 1, 2003, at 2:00 p.m. at the
Visual Arts Centre. The Central Lake Ontario Conservation
Authority has set their budget with quite a few projects located in
Scugog Township, which will benefit the whole region. The Friends
of Second Marsh will be opening a new Interpretive Centre.
Mayor Mutton advised as Chairman of the Ganaraska Conservation
Authority, he will be meeting with Minister Oulette regarding the
Ganaraska Forest. The Ganaraska Forest Centre is not in good
shape and he would like it entirely rebuilt. Mayor Mutton advised
that partnership funding is being looked into for an Interpretive
Centre regarding the Oak Ridges Moraine.
