Guiler, Town Manager DATE: November 15th, 1978 SUBJECT: Proposed Parking Lot Bowmanville Library and Museum In late October Mrs. Pat Best, Chairman of the Library Board requested the Public Works Department to consider the possibility of establishing parking facilities between the Library and Museum. The attached report was prepared by Mr. Ferguson on November 8th, 1978 and you will note that Mr. Thompson a member of the Museum Board feels that there is a restrictive clause in the deed which would prohibit the Town from creating off street parking for these facilities. We obtained a copy of the registered deed and the only clause which could be considered restrictive is as follows: " To have and to hold unto the Grantee for the establishment and maintenance of a park and museum to be used in connection with historical, cultural and recreational activities for the general benefit of the community." We agree that the above clause is restrictive in that it does suggest what the land is to be used for, but in planning a public facility parking should be considered and we feel that parking for these facilities would not be prohibited under this restrictive clause. We would recommend to Committee that a copy of Mr. Ferguson's report be sent to the Library and Museum Boards for their information and that they be invited to attend a meeting to discuss the proposals for consideration in the 1979 Budget.
