THAT Report ADMIN. 6-96 be received; REPORT #2 2. THAT, subject to written concurrence of Clarington Place Limited to an extension of the closing date being received by the Municipality prior to March 31, 1996, the closing date of the Agreement of Purchase and Sale between the Municipality and Clarington Place Limited which was authorized by Council's approval of Report PD -58-95, be extended to April 30, 1996, with the other terms and conditions of the Agreement remaining the same; and 3. THAT Clarington Place Limited be advised of Council's decision. REPORT: We are enclosing herewith a letter from the Municipal Solicitor in connection with the Agreement pertaining to Clarington Place Limited and the Municipality of Clarington, which we believe you will find self-explanatory. We would recommend that Council approve the following resolution: THAT, subject to written concurrence of Clarington Place Limited to an extension of the closing date being received by Municipality prior to March 31, 1996, the closing date of the Agreement of Purchase and Sale between the Municipality and Clarington Place Limited which was authorized by Council's approval of Report PD -58-95, be extended to April 30, 1996, with the other terms and conditions of the Agreement remaining the same. At that time, the Ontario Municipal Boards's Order implementing Official Plan Amendment 56, applicable to the Bowmanville West Main Central Area by enacting By -Law #94-16 applicable to Clarington Place Limited' s land holdings on Highway #2 had not been issued. The Board's Order was issued on February 23, 1996. Since that time, two other Agreements have been prepared and currently are being settled with Clarington Place Limited's solicitor, Mr. Ronald Worboy. These are an amendment to the Servicing Agreement between the Municipality and Clarington Place Limited dated May 24, 1994 and a Development Agreement. I hope that these Agreements will be executed by the parties and the necessary securities deposited with the Municipality within the next three weeks. However, it would be prudent to ask Council at its next meeting to authorize the extension of the closing date of the above transaction to April 30, 1996. I recommend that Council be asked to pass the following resolution at its next meeting: THAT, subject to written concurrence of Clarington Place Limited to an extension of the closing date being received by Municipality prior to March 31, 1996, the closing date of the Agreement of Purchase and Sale between the Municipality and Clarington Place Limited which was authorized by Council's approval of Report PD -58-95, be extended to April 30, 1996, with the other terms and conditions of the Agreement remaining the same.
