Resolution #C-552-04 Moved by Councillor Foster, seconded by Councillor MacArthur THAT the minutes of a regular meeting of Council held on October 25, 2004 and the minutes of a special meeting of Council held on November 1,2004, be approved. "CARRIED" . . . Council Minutes DELEGATIONS COMMUNICATIONS I - 1 M04.GE 1-2 F11.GE 1-3 M04.GE - 2- November 8, 2004 Pastor Doug Stevens, The Salvation Army, requested Council to waive the fees of $40.25 per month for an "On Street Parking Permit" for use on a municipal street. Pastor Stevens stated they are a charitable non-profit organization which comes to the aid of the community in times of distress and disaster. Their van is parked in front of their residence in readiness of these emergencies. Gary Hammett addressed Council in opposition to the proposed fence installation for the Storybook Homes Development on Auburn Lane, Courtice. Mr. Hammett stated the fence will take away from the esthetics of the subdivision and submitted a petition on behalf of the residents. Mr. Hammett is requesting: Council take the funds which were to be used to erect the fence and redirect the money to a local charity; and allow the developer, Halminen, to be released from the Certificate of Completion. "CARRIED" Murray Paterson, thanking the Mayor and Members of Council for the 2004 Senior Citizen of the Year Award. Elsii Caetano Faria, Artist, Orono, applauding the efforts between the Clarington Visual Arts Centre and the Rotary Club of Bowmanville. The funding provided by the Rotary Club allowed for the Clarington Visual Arts Centre physical changes and the partnership is one that recognizes the important impact of cultural and artistic organizations on the community at large. Harold Sellers, Oak Ridges Trail Association, thanking Council for their support in the trail opening ceremony at the Long Sault Conservation Area. Takhar, Minister of Transportation, submitting the Letter of Agreement to the Municipality of Clarington related to the funding provided by the Province under the Dedicated Gas Tax Funds for the Public Transportation Program. The Municipality of Clarington will be eligible to receive an allocation of $363,996 for the period October 1, 2004 to September 30, 2005. I - 13 T03.GO The Honourable Harinder S. Takhar, Minister of Transportation, forwarding a copy of correspondence to John O'Toole, MPP, thanking the MPP for the editorial on the extension of GO Transit rail service to Clarington. The government's priorities for GO Transit include increasing parking at GO Transit lots, putting more trains on exiting lines and capacity improvements of the rail infrastructure completion at Union Station and through Scarborough before any additional services can be introduced. . . . . Council Minutes COMMUNICATIONS 1-14 C06.CL 1- 15 TOO.GE I - 16 M08.GE 1-17 M04.GE D - 1 M02.GE - 4- November 8, 2004 Linda DelGrande, Acting Library Director, Clarington Public Library Board of Trustees, submitting to Council the audited financial statements for the year ended December 31, 2003 in accordance with the Public Libraries Act. Debra Taylor, Regional Director General, Transport Canada, Ontario Region, advising the Mayor on the progress of the Pickering Airport Site Zoning Regulations (PASZR). The enactment of PASZR is necessary to protect against incompatible development on lands surrounding the federal Pickering lands, so that when the demand dictates, a safe and viable airport remains an option. Kevin Wilson, Transportation Planning and Design, the Regional Municipality of Durham, advising of a "Public Open House" for upgrading Taunton Road (Regional Road 4), Harmony Road (Regional Road 33) and Townline Road (Regional Road 55), to be held on Tuesday, November 9, 2004 at 6:30 p.m. to 9:00 p.m. at Northview Community Centre, Oshawa. Gerri Lynn O'Connor, Mayor, The Corporation of the Township of Uxbridge, thanking all who attended the annual golf tournament at the Foxbridge Golf Course in Uxbridge. The event raised $2,400 for local charities and the "Fireflies" dragon boat team from Lindsay raised $411 towards the fight against Cancer. The 2005 event is scheduled for Tuesday, September 20, 2005. Resolution #C-554-04 Moved by Councillor Trim, seconded by Councillor Schell THAT the Correspondence Items be approved as per the agenda, with the exception of Items D - 3, D - 7 and D - 11 to D -13, inclusive. "CARRIED" John Greenfield, Secretary, Bowmanville and District Navy League, requesting permission to hold Sea Cadet Tagging on September 29, September 30, October 1, and October 2, 2005. As in the past, this is a major fund raiser for the Cadets and they will once again be in uniform in front of businesses throughout Clarington. (Approved selling of tags during Navy League Tag Days) . . . Council Minutes COMMUNICATIONS D-2 M02.GE D-4 A01.GA D-5 M02.GE D-6 M02.GE D-8 P14.GE -5- November 8, 2004 Bill Hasiuk, requesting permission to receive a Road Occupancy Permit for the 6th Annual Farmers' Christmas Parade of Lights on Wednesday, December 1,2004. Mr. Hasiuk advises Council that all the Farmers carry liability insurance. (Approved provided the organizers obtain a Road Occupancy Permit is from Engineering Services Department) Linda J. Laliberte, CGA, General Manager/Secretary-Treasurer, Ganaraska Region Conservation Authority, submitting a copy of the 2005 Preliminary Budget for review. All comments should be submitted by the December 9, 2004 Full Authority meeting as the decision is binding once the vote is taken and the levy is approved. The general levy for the municipality is $271,218. (Correspondence referred to the Director of Finance/Treasurer) Don Head, Acting Commissioner, Correctional Service of Canada, requesting Council to proclaim the week of November 14 - 21, 2004 as "Restorative Justice Week". The theme for 2004 is "Engaging Us All in the Dialogue" which highlights that restorative justice approaches to conflict provide all concerned parties with opportunities to participate in, and learn from, respectful dialogue. (Proclaimed) Pitch-In Ontario, requesting Council to proclaim the week of April 18 - 24, 2005 as "Pitch-In Canada Week". (Proclaimed) John O'Toole, MPP, Durham, supplying Council with a news release from the Ontario's Attorney General regarding Minister Bryant's plans to introduce a breed-specific ban against pit bulls. The legislation, if passed, would: - Ban pit bulls; - Muzzle existing pit bulls, impose other province-wide restrictions to improve public safety, and allow municipalities to impose appropriate controls; and - Increase fines up to a maximum of $10,000/jail sentences of up to six months. Council Minutes COMMUNICATIONS 0-9 M04.GE R01GE 0-10 D19.GE 0-3 T07.GE 0-7 M04.GE -6- November 8, 2004 Lori Theoret, Media Relations and Marketing Coordinator, Ontario Heritage Foundation, inviting Council to participate in the Young Heritage Leaders 2004 program to recognize youth, under the age of 18, who have made valuable contributions to local heritage preservation in their community. (Correspondence referred to the Municipal Clerk to place an advertisement in the local newspaper) Blair and Joanne Smyth forwarding a petition from residents of Scugog Street, from the intersection of Scugog Street and Middle Road to the intersection of Concession Road 3 and Regional Road 57, who oppose the proposed street name change. (Correspondence referred to the Director of Planning Services) Adela Pugliese, requesting Council to revisit the issue of a four-way stop at the intersection of Boundary Road and Old Scugog Road in Burketon. The traffic calming implemented has not succeeded in slowing down the traffic on Old Scugog Road. "CARRIED" Frank Hoar, Secretary, Newcastle - Bond Head Ratepayers Association, requesting the Municipality of Clarington - Operations take on the responsibility of maintaining grass cutting at the entrances to Newcastle; Highway 2 West, south side from Rudell Road to the entrance of the Lions Trail; Highway 2 East, north side . . . Resolution #C-556-04 Moved by Councillor Trim, seconded by Councillor Schell THAT Correspondence Item 0 - 11 be referred to the Director of Operations. "CARRIED" Pastor Douglas Stevens, The Salvation Army, requesting Council to waive the fee of $40.25 per month for an "On Street Parking Pass" for the Salvation Army vehicle. This vehicle must remain outside their home in readiness to respond to any emergencies within the community. The purchasing of a monthly parking pass will take further funding from their organization. Resolution #C-557-04 Moved by Councillor Schell, seconded by Councillor MacArthur THAT the request of Pastor Douglas Stevens, The Salvation Army, to waive the fee of $40.25 per month for an "On Street Parking Pass" be approved. "CARRIED" Kimberley Kitteringham, Deputy City Clerk, The Corporation of the City of Oshawa, submitting a copy of correspondence to The Right Honourable Paul Martin, Prime Minister, House of Commons, advising that at a meeting held on October 4, 2004, their Council passed the following resolution regarding General Motors of Canada Limited - Project Beacon: "That whereas General Motors of Canada Limited (GMCL) has proposed a bold new initiative, Project Beacon, to accelerate Canadian-based automotive innovation and competitiveness in conjunction with Canadian education . . . Council Minutes COMMUNICATIONS -8- November 8, 2004 institutions and automotive suppliers (including auto parts, steel, aluminum, research and development, manufacturing innovation etc.), which will include a significant involvement of the University of Ontario Institute of Technology (UOIT) and Durham College, as well as other educational institutions such as Fanshawe College, McMaster University, University of Waterloo, McGill University, Sherbrooke University, Montreal Ecole Polytechnique, Institut National de la Recherche Scientifique and Niagara College who are currently/potentially involved in the project. And by such action significant high skilled training will be delivered by UOIT and Durham College; and, Whereas UOIT and Durham College are critical to Oshawa's economic prosperity and that Project Beacon will enhance the research role of UOIT; and, Whereas GMCL will increase their competitive advantage in the automobile/transportation markets by modifying their manufacturing technology and processes to enhance flexibility resulting in a positive impact on employment in Oshawa and throughout the Region of Durham; and, Whereas Project Beacon will enhance and increase the design and engineering capacity of GMCL and through the new proposed Automotive Innovation Network, GMCL will direct more than 130 million dollars in new support towards the training of the next generationof Canadian automotive engineers and designers; and, Whereas accelerating the commercialization of automotive/ transportation related research and development in Canada -a key element of much broader return on investment would be achieved by government support of Project Beacon; and, Whereas GMCL is in discussions with the Ontario and Federal governments concerning their participation in Project Beacon's investments and initiatives for Canada and Ontario; . . . Council Minutes COMMUNICATIONS -9- November 8, 2004 Therefore be it resolved that the Council of the City of Oshawa strongly encourage the Ontario and Federal governments to partner and financially support General Motors of Canada Limited's Project Beacon; And further copies of this resolution be forwarded to the Right Honourable Prime Minister Paul Martin, Ralph Goodale, Minister of Finance, David Emerson, Minister of Industry, Joe Volpe, Minister of Human Resources and Skills Development, Premier Dalton McGuinty, Joe Cordiano, Minister of Economic Development and Trade, Mary Anne Chambers, Minister of Training Colleges and Universities, Greg Sorbara, Minister of Finance, Christopher Bentley, Minister of Labour, Stephen Harper, Leader of the Opposition, Jack Layton, NDP Leader, Gilles Duceppe, Leader of the Bloc Quebecois, and all local MP's and M PP's, whose constituency lie in the boundaries of Oshawa, Durham Region, City of Kawartha Lakes, Cobourg, Port Hope, Northumberland County, City and County of Peterborough, Waterloo Region, Niagara Region, York Region, City of Toronto, City of Hamilton, as well as the Regional and local Municipal Councils of the above cities and regions, as well as the Mayors for Automotive Investment, as well as the cities of Montreal and Sherbrooke in the Province of Quebec, the Boards of Trade, Chambers of Commerce in Durham Region and Northumberland and Peterborough Counties and the City of Kawartha Lakes, UOIT/Durham College Board of Directors and Durham Region Manufacturers' Association, requesting their support of this resolution regarding Project Beacon." Council Minutes November 8, 2004 - 10- COMMUNICATIONS 0-13 F11.GE Dr. Kathlynn Hoch, Ontario Speed Skating Oval Capital Campaign Committee, requesting support for a Regional training facility - the Ontario Speed Skating Oval, Lakefield. She is requesting that Council forward a letter of support to Bev Oda, M.P. and John O'Toole, M.P.P. and purchase either a Standard Brick ($200), an Ontario Brick ($300) or a Canada Brick ($1,000). Speed skating is an incredibly strong sport in Canada and the facility will allow skaters the opportunity, the training facility, and programs to represent their country at international competitions. Council Minutes November 8, 2004 - 11 - REPORTS Report #2 Resolution #C-561-04 Letter of Moved by Councillor Robinson, seconded by Councillor Pingle Agreement Dedicated Gas Tax THAT Report EGD-51-04 be received; THAT the Mayor and Clerk be authorized to execute, on behalf of the Corporation of the Municipality of Clarington, the agreement with the Province of Ontario, represented by the Minister of Transportation for the Province of Ontario attached to Report EGD-51-04, setting out the terms and conditions for the use of dedicated gas tax funds by municipalities for public Transportation; THAT the by-law attached to Report EGD-51-04 to confirm its decision to enter into an agreement with the Province of Ontario, represented by the Minister of Transportation for the Province of Ontario be approved; and THAT a copy of Report EGD-51-04, Council's resolution, the by-law and two fully executed copies of the Letter of Agreement be forwarded to the Ontario Ministry of Transportation for the Ministry's records.
