Fanning, Director of Community Services Klaas Degroot, Treasurer Don Smith, Director of Planning Jim Hayman, Area Fire Chief Resolution #C-281-81 Council Minutes Moved by Councillor Taylor, seconded by Councillor Woodyard THAT the Minutes of the Council meeting held Febl"uary 23 1981 be approved. "CARRIED" Mr. David Reid of Frank Cowan Insurance Company Limited, the Town's Insurance Agents appeared before Council to explain the claims procedure with regard to the Town's Public Liability Policy. Mr. Reid also answered questions of members of Council. Resolution #C-282-81 Moved by Councillor Woodyard, seconded by Councillor Cowman Committee of the Whole THAT the meeting 90 into Committe of the Whole. "CARRIED" Resolution #C-283-81 Moved by Councillor Prout, seconded by Councillor Woodyard In Camera THAT the meeting be In Camera to discuss confidential insurance matters. "CARRIED" . . . "CARRIED" Resolution #C-285-81 Moved by Councillor Taylor, seconded by Councillor Woodyard THAT the Committee rise. "CARRIED" Resolution #C-286-81 Moved by Councillor Prout, seconded by Councillor Cowman THAT the agenda be changed to deal with Item D-17 and the Director of Public Works report WD-42-81 at this time. "CARRI ED AS AMENDED" Resolution #C-287-81 Moved by Councillor Hamre, seconded by Councillor Hubbard THAT the foregoing resolution be amended to provide that Mr. Michaels, representing Hale's Disposals,be heard. "CARRIED" Resolution #C-288-81 Moved by Councillor Cowman, seconded by Councillor Woodyard THAT the meeting be in Committee of the Whole. "CARRI ED" Mr. Michaels thanked Council for having the opportunity of addressing it and for the quick action it had taken to endeavour to alleviate the Disposal Operators' problems. He asked Council to grant interim relief by by-law and advised that he was trying to secure an appointment with M.T.C. officials with the view of arriving at a more permanent solution to the problem. Council Mi nutes Committee Rise In Came ra -3- March 9 1981 Resolution #C-290-8l Moved by Councillor Taylor, seconded by Councillor Woodyard THAT Council authorize staff to consult with the dele9ation and draft and present a by-law to permit relief from By-Law 80-41 and draft and present an agreement regarding a permit fee or performance bond and report back. "CARRIED" Resolution #C-29l-8l Moved by Councillor Cowman, seconded by Councillor Hamre THAT the fore9oin9 resolution be tabled and referred to Mr. Sims to review and recommend to Council how the terms of reference should be worded. "MOTION LOST" Resolution #C-292-8l Moved by Councillor Cowman, seconded by Councillor Hamre THAT Resolution #C-290-8l be amended to provide for the alternative of a licence fee for the trucks and specifying the route for the hauling of garbage. "MOTION LOST" On being put to a vote resolution #C-290-8l was carried. Resolution #C-293-8l Moved by Councillor Cowman, seconded by Councillor Prout THAT the Committee rise. "CARRIED" Resolution #C-294-8l Moved by Councillor Cowman, seconded by Councillor Woodyard THAT the action taken In Camera be approved. Council Mi nutes Agenda Recess -4- March 9 1981 Resolution #C-295-8l Moved by Councillor Prout, seconded by Councillor Taylor THAT Council continue with the agenda and postpone the Finance and Administration Committee meeting scheduled for 2 p.m. until after Council agenda is finished. "CARRIED" Resolution #C-296-8l Moved by Councillor Woodyard, seconded by Councillor Cowman THAT the meeting be recessed till 2 p.m. (time 12:30 p.m.). "CARRIED" The meeting was reconvened at 2 p.m. with the same people in attendance. Mr. Sims reported that the Garbage Disposal Operators are prepared to pay a fee of $50 per truck for licence for Garbage or Waste Disposal or promise a bond and to use routes as per the Director's report. Mr. Sims recommended a letter of credit rather than a bond but advised that there could be problems in monitoring the damage. Resolution #C-297-8l Moved by Councillor Hubbard, seconded by Councillor Woodyard THAT the Disposal Operators' request be complied with and that permits be issued to haul Domestic and Industrial Waste until May 21 1981 on the basis of a letter of credit in the amount of $25,000 and that the route be as recommended by the Director of Public Works in report WD-42-8l. Council Minutes Delegation Mr. Ken Hoope r Recess -5- March g 1981 Resolution #C-299-81 Moved by Councillor Cowman, seconded by Councillor Taylor THAT the foregoing resolution be tabled to allow the Town Solicitor to negotiate further with the operators on a Licence/Permit basis. "CARRIED" Mr. Ken Hooper requested to address Council but there was no motion to suspend the Rules of Procedure to permit this.
