HomeMy WebLinkAbout09/29/1980 - . . REPORT II 2 Mayor Rickard and Members of Council: The following is a report of the meeting of the Planning and Development Committee held on September 29, 1980. 1. Rezoning Z-A-2-l3-2 (Noseworthy) It was recommended to Council that (1) Report P-146-80 relative to application for rezoning number ~-A-2-l3-2 part of Lot 11, B.F. Concession, former Town of Bowmanville (Edward and Gloria Noseworthy) be received for information. (2) The attached by-law 80-126 be forwarded to Council for information. (3) Staff be authorized to negotiate an agreement with the proponent guaranteeing that the existing cottage on the site will not be used for residential purposes and acknowledging that the road abutting the site is a private road which is not maintained by the municipality; (4) Once the above noted agreement has been executed by the Town and the propnent, the attached by-law 80-126 be forwarded to Council for approval; and (5) The Region of Durham be advised of Council's action in respect of the subject application. 2. O.M.B. Hearing By-law 79-106 - Schweizer It was recommended to Council that the decision of the Ontario Municipal Board Hearing re Town of Newcastle By-law 70-106 (Schweizer) be received for information. 3. Subdivision l8T-19720 - Romney Mead It was recommended to Council that the following resolution be adopted and forwarded to the Plans Administration Division of the Ministry of Housing: "The Town of Newcastle hereby request the Minister of Housing to extend the draft plan approval of subdivision l8T-19720 to September 30, 1981" and a recommendation to next year's Council to look favourably upon an additional three months' extension provided East Woodbridge honours the commitments they have before the Town at the present time and the extension be conditional upon East Woodbridge providing a letter of undertaking to carry out the commitments. 4. Pits and Quarries Licencing By-law and Development Agreement It was recommended to Council that report P-149-80 be received for information and the drattPits and Quarries Licencing By-law and draft Pits and Quarries Development Agreement be forwarded to the Town's Solicitor for review and comment prior to coming to Committee and Council for consideration. . . . - 2 - Report 1/2 5. Invoice Townline Shopping Centre Petition to Cabinet It was recommended to Council that they instruct the Treasurer to pay the attached invoice from D. B. Greenspan in the amount of $1,544. dated August 25, 1980, from account 7702-207-000. 6. Mainstreet Revitalization Program It was recommended to Council that report P-15l-80 re Mainstreet Revitalization Program be received for information. 7. Hamlet Survey - Hampton, Mitchell's Corners and Orono It was recommended to Council that report P-152-80 - Hamlet Survey, Hampton, Mitchell's Corners and Orono, be received for information. 8. Rezoning Z-A-3-3-5, (Zosik) It was recommended to Council that the applicant for rezoning number Z-A-3-3-5, part lot 29, Concession 3, former Township of Clarke, 394256 Ontario Limited, Mr. H. Zosik, be requested to submit revised plans. 9. Rezoning Z-A-1-6-6 - (Croth) It was recommended to Council that by-law 80-127, rezoning Z-A-1-6-6, part lot 31, Concession 2, Darlington (Mr. D. Croth) be forwarded to Council for approval at the next regular meeting. 10. Proposed Subdivision Agreement l8T-78l07 (Davis) It was recommended to Council that; (1) Report P-160-80 re proposed subdivision agreement - Draft Approved Plan of Subdivision Number l8T-78l07, Ralph Davis be received for information. (2) The attached subdivision agreement for the Ralph Davis Subdivision be executed by Council; and (3) The Town Clerk be requested to prepare a by-law for the purpose of authorizing the execution of the agreement, to be presented to a subsequent meeting of Council. . . . - 3 - Report 1/2 11. Courtice Environmental Impact Analysis It was recommended to Council that; (1) Report P-162-80 be received (2) The firm of Gartner Lee Associates be retained to carry out the Courtice Environmental Impact Analysis in accordance with their submitted proposal and the adopted terms of reference, less the optional public consultation; (3) Staff be authorized to investigate and to require the consultants to carry out additional field investigations above and beyond those outlined by the submitted proposal but at a cost not to exceed the difference between the quoted price and the Council approved budget for the study. By-law Number 80-126 A By-law to amend Restricted Area By-law Number 1587, as amended, of the former Town of Bowmanville. WHEREAS the Council of the Corporation of the Town of Newcastle DEEMS it advisable to amend Restricted Area By-law Number 1587, as amended, of the former Town of Bowmanville. NOW THEREFORE the Council of the Corporation of the Town of Newcastle ENACTS as follows: 1. Schedule 'A' to By-law 1587, as amended, is hereby further amended by changing to SPECIAL CONDITION 16 the zone designation of the lands indicated as "ZONE CHANGE TO SPECIAL CONDITION 16" . on the attached Schedule "X" hereto, and by adding to the lands so indicated cross hatching and the figure 16 encircled. 2. Schedule 'B' to By-law 1587, as amended, is hereby further amended by adding thereto the following SPECIAL CONDITION 16 as follows: "SPECIAL CONDITION 16 The lands shown on Schedule "A" cross-hatched and marked with the figure 16 encircled shall be subject to the special regulations hereinafter contained and where there is any conflict between the regulations hereinafter set out and any provision of By-law 1587, as amended, then the provisions of this Special Condition shall apply, but in all other respects, the provisions of By-law 1587, as amended, . shall apply. /: (" rv ~ 1) /' - 2 - . 1.1 Defined Area The area subject to this Special Condition is shown cross- hatched with the figure 16 encircled on Schedule "A" hereto. 1.2 Permitted Uses No person shall use any of the lands in the defined area, or erect, alter, or use any building or structure on such lands for any purpose except one or more of the following uses, namely: one single family dwelling uses, buildings and structures accessory thereto. 1.3 Zone Provisions . (i) Lot Area (minimum) 1317.0 square metres (ii) Lot Frontage (minimum) 30.5 metres (iii) Front Yard (minimum) (a) Single Family Dwelling 6.0 metres (b) Accessory Building or Structure 27.5 metres (iv) Side Yard (minimum) (a) Single Family Dwelling 10.5 metres (b) Accessory Building or Structure 5.0 metres (v) Rear Yard (minimum) (a) Single Family Dwelling 24.5 metres (b) Accessory Building or Structure 6.0 metres (vi) Building Height (maximum) 10.5 metres . (vii) Lot Coverage (maximum) 10% . - 3 - 1.4 Frontage on Private Road Notwithstanding any provision of this By-law to the contrary, the lands within the "Defined Area" shall be considered a "lot", as defined in By-law 1587, notwithstanding the fact that the lands do not have frontage on a public highway." 3. This By-law shall come into effect on the date hereof, subject to the provisions of Section 35(10) of the Planning Act. BY-LAW READ a first time this day of A.D. 1980.
