We will not dispose of such materials on any property owned by the Owner. * We will comply with the requirements of the Occupational Health and Safety Act, the Environmental Protection Act, and all regulations under those Acts, and all other applicable statutes, and we will cause my workers to comply. Tenders must be submitted on the forms provided and in the envelope provided with this package. 3. Two sets of tender forms are provided. Bidders shall complete and return one set of forms. 4. Bid Bond -Not required. 5. The Contractor shall provide and maintain at their own expense, a policy of general liability insurance issued by an insurance company incorporated or licensed to conduct insurance business in the Province of Ontario during the entire contract period. General liability insurance shall be in the joint names of the Contractor and the Board with limits of not less than two million (2,000,000.00) dollars inclusive per occurrence for bodily injury, death, and damage to property including loss of use thereof. The Contractor shall provide proof of insurance prior to commencement of the Work. Fire Insurance The Contractor and Sub-contractors shall be responsible for Fire Insurance on their own plant and the equipment. 6. Performance Bond -Not required. Persons of firms submitting Tenders shall be actually engaged in the line of work required by these Contract documents and shall be able to refer to work of similar character performed by them. 8. A mandatory pre-tender meeting to review the project requirements has been scheduled for: Failure to attend the site meeting will disqualify the prospective bidder. 9. It is the Bidders responsibility to examine the project location prior to submitting a tender for this work, in order to thoroughly acquaint themselves with all existing conditions at the site which may affect the proper completion of the work specified. Bidders shall report to Durham Energy Specialist Ltd., all discrepancies, omissions, errors, departures from codes or good practice and points considered to be of dubious intent, so that the Owner may, if desirable, issue instruction by addenda at least five working days before Tender Closing Date. The Owner will not be responsible for any oral instructions. All Addenda shall be incorporated in the proposals and shall become a part of the Contract Documents, and their receipt shall be acknowledged on the Tender Form in the space provided. 11. Bidders shall submit with the Tender Price Schedule a complete list of the Suppliers they propose to use for their components. Changes in this list will be not permitted without written approval from the Owner. 12. If a Bidder intends to use the services of an installation sub-contractor, the Subcontractors name(s) must be listed on the form of tender. 13. Where material is supplied by the bidder which is subject to Provincial Sales Tax, the unit prices involving such materials shall include the applicable Provincial Sales Tax. 14. The Goods and Services Tax is extra and shall be shown in the space provided on the tender form. 15. Bidders shall submit prices for all items listed in the Form of Tender. Partial bids within the Form of Tender will not be considered for acceptance. 16. The Unit Prices indicated shall include all labor, materials and equipment required to complete the work specified in a satisfactory and workmanlike manner. All work is to be done in accordance with the specifications as described in this tender as detailed on the drawings and as directed on the site. 17. The Contractor shall include with their tender submission, a copy of their most recent Worker's Compensation Board Firm Detail Profile Report, CAD-7 or NEER. This report will be a consideration in the evaluation and award of the tender. 18. The Contractor/Supplier shall guarantee against defect and maintain/warranty the entire work called for under this Contract for a period of one year from the date of completion of the project, unless otherwise stated within the technical specifications. 18. Tender shall be irrevocable and valid for acceptance by the Owner for a period of sixty (60) days from the tender closing date. 19. The Owner and/or Durham Energy Specialist Ltd. reserve the right to: a) Cancel the tender at any time prior to acceptance of a tender bid; b) Evaluate submissions based on past performance, timely project completion, appropriate manpower, equipment and facilities; c) Reject any or all bids; d) Cancel any order if the goods or services are unsatisfactory; e) Accept the tender in whole or in part; f) Not to accept the lowest or any tender. 20. Without limiting the generality of the foregoing, any tender which is incomplete, illegible, obscure or which contains alterations not called for, or irregularities of any kind, may be rejected. 21. It is the Bidder's responsibility to obtain and pay for any permits required prior to the commencement of the work. Page 9 Garnet B. It is the Bidder's responsibility to abide by all Provincial, Regional, and Municipal regulations regarding the transportation and disposal of the waste material involved in this work. 23. The successful contractor will be required to submit an anticipated "Construction Schedule" as per Supplementary General Requirements and attend apre-construction meeting. The bidders shall indicate the proposed completion time in the space provided on the tender form. 24. Construction shall not occur on Sunday, unless authorized by the Owner: 25. Project meetings will be held as required by Durham Energy Specialist Ltd. Subcontractors will be expected to attend when requested. The cost of attendance shall be included in the Tender Sum. 26. Mark-up for work not included in the contract and for which unit, separate, and itemized prices cannot be applied, shall be applied as follows: Contractor's own forces 10% Contractor on work of Sub Trades 5% Sub Trade's own work 10% 27. The Contractor shall obey all Federal, Provincial and Municipal Laws, Acts, Ordinances, Regulations, Orders-in-Council and Bylaws, which could in any way pertain to the work outlined in the Contract or to the Employees of the Contractor. Without limiting the generality of the foregoing, the Contractor shall satisfy all statutory requirements imposed by the Occupational Health and Safety Act and Regulations made there under, on a Contractor, a Constructor and/or Employer with respect to or arising out of the performance of the Contractor's obligations under this contract. 28. The Contractor shall be aware of and conform to all governing regulations relating to employee health and safety. The Contractor shall keep employees and Subcontractors informed of such regulations. 29. The Contractor is responsible to protect his/her equipment, materials and work against damage as well as protect the public against injury by hoarding off the construction areas as necessary. 30. Monthly payments shall be made net thirty (30) days after completion of work as outlined in monthly progress bills. 31. The Contractor will be required to submit to Durham Energy Specialist Ltd. a statement from the Worker's Compensation Board that all assessments the Contractor is liable to pay under the Worker's Compensation Act or successor legislation have been paid. Such statement or Certificate of Clearance shall be provided prior to the issuance of the Contractor's last payment and at any other time when requested to do so. 32. Failure or inability to comply with all the conditions set out in this tender shall facilitate the need for the Owner or Durham Energy Specialist Ltd. to issue a Stop Work Order and to cancel the contract without notice. Page 10 Gamet 8. Rickard CONSTRUCTION SCHEDULE DES Jab No. OS-845 Caclinn R. Perna 19 The Contractor shall submit a construction schedule seven days prior to construction in the form of a bar chart indicating the critical activities and dates. Modify schedule if required by the Owner and/or Durham Energy Specialist Ltd. and resubmit. The schedule format should allow plotting of actual progress against scheduled progress. The schedule will be posted at the job site. A schedule will be submitted by Contractor to Durham Energy Specialist Ltd. indicating the delivery of material and equipment supplied by others. The Contractor shall provide a 24 hour contact person to be reached in the event of an emergency as a result of the work being done. The Contractor shall be responsible for any remedial work as a result of the performance of this contract. If such work has to be done by others in order to keep the school environment safe and operational then the expense incurred will be deducted from the total contract price. In any contract in excess of $50,000.00, the Contractor will be required to complete a Notice of Project and submit to the Ontario Ministry of Labour and post original at the job site. Richard December 1, 2005 2440aUng Street:West Specifications DES Job No. 05-845 Bowmanvlne'floiy - IiVAC Eauiament Replacement Pape 1 GENERAL General Requirements a) It is the intent of these drawings and specifications to provide for a mechanical installation complete and in operating condition. The responsibility for supplying and installing all material necessary to accomplish this, except where specifically noted that such work or materials is not included, shall be part of this section. b) The drawings and specifications are not a detailed set of installation instructions. Drawings and specifications are complementary to one another and that which is shown on one is as binding as that which is shown on both. c) Follow manufacturer's recommended installation details and procedure. for equipment supplemented by the contract documents. d) The Engineer shall be immediately informed of any discrepancies between drawings and specifications leaving in doubt the true intent of the work. e) Assess and he familiar with existing conditions where possible and allow for same in the tendered price. f) All work must be done by qualified andlor certified persons in such line of work. Trade certificates must be available on demand. g) All material used shall be new and installed in accordance with manufacturers instructions. h) Uniformity of manufacturer shall be maintained for particular types of equipment used in similar applications and sizes. i) It is the responsibility of the Contractor to store and protect materials supplied by this scope. Materials must be stored in original containers. j) Provide connection of mechanical system to equipment furnished in other Sections and by Owner, including uncrating equipment, moving in place and installing complete, start-up and test. k) The mechanical system shall comply with the requirements of the current edition of the Ontario Building Code, revisions thereto, the Ontario Plumbing Code, local ordinances, NFPA, and the Fire Protection Act. I) The electrical system shall comply with Ontario Electrical Safety Authority, Ontario Hydro, local PUC, and other local ordinances. m) Provide work in accordance with the requirements of all applicable government codes, local by-laws, underwriter's regulations base building standards, contract documents, and all authorities having jurisdiction. "Carry out any changes required by the authorities having jurisdiction without extra expense to the Owner." n) Submit to the Engineer and Owner, current MSDS Sheets for any products being used on the job site where they exist. 2. Permits and Fees a) Apply for, obtain, post, and pay for all permits, fees, connections, inspections, licenses, certificates or charges necessary including all provincial tax and G.S.T. b) Apply for, obtain, and post, and pay for Notice of Project as where applicable and as required. c) Upon completion of project, provide inspection certificates confirming acceptance by all authorities having jurisdiction for the following disciplines -ductwork, plumbing, gas, electrical, and fire systems as required. Changes to Original Contract a) Changes to original contract shall not proceed until written notification from the Engineer or Owner's representative. b) Atl changes shall be broken down showing all itemized costing for materials, labour, and mark-up separately. Extras will not be approved until such breakdown is provided. c) Mark-up for work not included in the contract and for which unit, separate, and itemized prices cannot be applied, shall be applied as follows: Contractor's own forces ~p% Contractor on work of Sub Trades 5% Sub Trade's own work ~ p% 4. Record Drawings a) Maintain accurate as-built drawings on an on-going basis to be reviewed periodically by Consultant during construction. b) Upon completion of the work, submit to the Engineer for review, one (1) complete set of clear, legible, certified as-built drawings. c) Mark final location of all fire dampers and access doors on same for future service requirements. d) Arrange and pay to have as-built markings transferred to AutoCAD computer disk and submit to Engineer at completion. e) Insert one (1) final set in each of three (3) maintenance manuals. 5. Working Hours a) Confirm working hours with Owner. b) Where work interferes with normal business operations within the building where work is being done, work shall be done after hours unless approved by the Owner. 6. Workplace Safety a) The workplace must be kept safe at all times. b) Conform to all ministry of labour, and health and safety regulations at all times. c) Provide proof of WHMIS training where applicable. d) Use ladders and proper techniques as approved by the ministry of labour e) f) 9) h) i) December 1, 2005 to perform all provide barriers around hazards, etc. to ensure occupants and Where work does not conform to such regulations, stop work immediately and report the situation to the Owner's representative or Consultant or rectify the situation immediately. Maintenance Manuals a) Provide the Owner with three (3) indexed, hard cover maintenance manuals industry standards containing: - Table of Contents - Brief description of systems - Warranty Letter - Certificates of acceptance and approval by reviewing authorities - Copy of permits - Stamped approved shop drawings - Installation Instruction Manuals - Maintenance instructions and requirements - Complete parts list of all systems and components - As-built drawings b) Submit to the Engineer for review and approval prior to turnover to Owner or final approval. 11. Separate Prices a) Provide price breakdown as per tender forms to be used by the Owner in case the overall pricing is above the budget. 12. Job Completion a) All work including all startup shall be completed prior to issuance of "Final Review Certificate" from the Engineer. SUPPLEMENTAL GENERAL REQUIREMENTS 1. Cutting, Coring and Patching (Above Grade) a) All cutting and coring shall be by the Mechanical Contractor or his sub trades. b) Patching of walls and floors shall be shall be by the Mechanical Contractor or his sub trades. Any patching required due to unnecessary damage and not directly related to the new installation is the responsibility of the Mechanical Contractor or his sub trades. 2. Access to Equipment a) Maintain adequate access to all equipment, valves, dampers, fire dampers, cleanouts, traps and controls as per manufacturer's recommendations for proper maintenance. b) Provide coloured sticker dots on ceiling grid to indicate location of best access to equipment in ceiling space. c) Include legend of dots in the maintenance manual.. 3. Ceilings a) Remove existing ceilings in the area of work where necessary. b) Repair any damaged ceilings as required to match existing. 4. Final Patching, Finishing and Painting a) The Contractor is totally responsible for all final finishing in areas where they have carried out revisions to the plumbing services. b) Provide all concrete, drywall, flooring and ceiling repairs to match the existing surfaces. c) Provide final painting consisting of one prime coat and two finish coats to match the existing colours in the area of the repairs. Provide colour chips to Municipality of Clarington for final colour selection. d) Consult with the owner to obtain type and color of paint required. e) Allow to paint out the entire wall of the area so as to prevent any shade or aging mismatch. f) Employ the services of skilled tradesmen in the type of work required. g) The final acceptance of the finishing will be up to the Engineer /Owner. Use fire retardant material at fire separations. e) Place sound insulation inside the curb (loose fit). 4. Gas Piping a) Tie into existing gas service at main. Extend new gas piping to the new rooftop units complete with gas valve, union and final connection to new unit. b) Provide a CGA approved ball valve and union where new equipment is to be connected. c) Provide sleepers for gas piping on roof as per detail drawing. d) All gas piping installations shall comply with CGA code CAN 1-6149, gas safety branch bulletins, local codes and NFPA 96. e) Gas piping for low pressure shall be black steel schedule 40, complete with screwed fittings and valves up to 2" and welded fittings and valves 2'/~' and over. Concealed gas piping shall be of welded construction. f) Label "gas" in black on yellow complete with flow arrows in accordance with CGA code CAN 1-B149. Outside piping and supports to be painted with 2 coats of weatherproof paint to match building colour. g) Provide a 1 hour test of all gas piping up to 11" pressure. 5. Duct Sealing a) Seal all NEW ducts, and EXISTING accessible ducts to be reused, with Durodyne duct sealer to provide maximum 5% air leakage throughout. 9.
