Present Were: Mayor G. B. Rickard Councillor A. Cowman Councillor D. Hamre Councillor 1. M. Hobbs Councillor M. Hubbard Councillor R. B. Taylor Absent: Councillor E. R. Minutes Resolution #C-725-84 Moved by Councillor Cowman seconded by Councillor Hamre THAT the Minutes of a Regular Meeting of council held on Tuesday, November 13, 1984, be approved as corrected. "CARRIED" Resolution #C-726-84 Moved by Councillor Cowman, seconded by Councillor Hamre THAT the Minutes of a Special Meeting of Council, held on Monday, November 19, 1984, be approved as read. "CARRIED" Delegations Mr. Craig Greentree, Coach, representing the "My Apothecary" Ladies Lobb Ball Team, advised Council that the team had been banned from the Town of Newcastle Ladies Slo Pitch League for the 1985 playing season. He stated that the action was unconstitutional and, because the Town provided the playing fields and scheduling that Council should look into the matter of the league's operation. He suggested further, that the Team had no other recourse than to look to Town Council to resolve the problem. . Council Minutes Delegations . Conununications . 1-2 Summary of Minutes of the Port Granby Waste Management Facility Monitoring Conuni ttee . - 2 - November 26, 1984 Mr. Ken Hooper, advised Council, that he had not received any replies to inquiries that staff had been directed to be replied to. In particular, he noted that on October 27, 1983, he had written to Council about certain matters; That his correspondence had been forwarded to the Administrator for reply on November 9th 1983 and over one year later he still had not had a reply. On November 28th 1983, he had appeared as a delegation and staff had been directed to reply: still, he had not received an answer. With respect to other matters, Mr. Hooper requested, that as expense accounts were not confidential that he be given permission by Council to review these accounts. As well, Mr. Hooper indicated that he disapproved of out-of-Town meetings being attended by staff and cited a November 9th 1984 meeting attended by a representative of the Treasury Department and an upcoming meeting scheduled for November 30th 1984 to be attended by a member of staff. Attendance at such meetings is in poor taste, not appropriate and wastes taxpayer's money. D - 2 Ontario Good Roads re Funding for Municipal Roads in Ontario . - 3 - REsolution #C-729-84 Moved by Councillor Hobbs, seconded by Councillor Hamre THAT the correspondence dated November 9th 1984, from Mr. James Slyfield, respecting Assessment Appeals be received for information. "CARRIED AS AMENDED" Resolution #C-730-84 Moved by Councillor Hobbs, seconded by Councillor Cowman THAT the previous resolution dealing with Mr. Slyfield's letter respecting Assessment Appeals be replied to by the Treasurer. "CARR I ED" Resolution #C-731-84 Moved by Councillor Hobbs, seconded by Councillor Taylor THAT the correspondence dated November 12, 1984, from Raymond J. Stewart, Supervisor of Transportation, Peterborough- Victoria-Northumberland and Newcastle Roman Catholic Separate School Board, requesting that a school bus "Loading Zone" be established at St. Stephen's School, 80 Rhonda Blvd., Bowmanville, be received; AND THAT the correspondence be referred to the Director of Public Works for review and report to the General Purpose and Administration Committee. "CARRIED" Resolution #C-732-84 Moved by Councillor Taylor, seconded by Councillor Hamre THAT the correspondence dated November 1st 1984, from Mr. William P. Taylor, President, Ontario Good Roads Association be received; AND THAT the resolution appended thereto be endorsed by the Council of the Town of Newcastle and forwarded to The Honourable Larry Grossman, Q.C., Treasurer of Ontario; Dr. E. E. Stewart, Secretary of the Cabinet and Clerk of the Executive Council, and The Honourable James W. Snow, Minister of Transportation and Communications: CQuncil Mintues . Recess Notice of Motion . - 4 - The Resolution Reads as follows: November 26, 1984 "THAT the Corporation of the Town of Newcastle endorses the concerns expressed by the Ontario Good Roads Association respecting the inadequacy of the funds made available by the Government of Ontario, for Municipal Road Subsidy as expressed in their brief to the Ontario Cabinet Committee on resources development dated November 1, 1984, and further that a copy of this resolution be forwarded to the Treasurer of Ontario, the Secretary to the Ontario CAbinet and the Minister of Transportation and Communications;" AND FURTHER THAT Mr. Taylor be advised of Council's actions. "CARRIED" Resolution #C-733-84 Moved by Councillor Hobbs, seconded by Councillor Taylor THAT Mary M. Clarke's letter of resignation from the Newcastle Community Services Planning Board (undated) received November 21st 1984, be accepted with regret; AND THAT Mary M. Clarke be thanked for her contribution to the Board's activities; AND FURTHER THAT the correspondence be referred to the Striking Committee. "CARRIED" The meeting reconvened at 8:35 p.m. Resolution #C-735-83 Moved by Councillor Cowman, seconded by Councillor Hubbard WHEREAS the Council of the Town of Newcastle did, at the meeting of Tuesday, November 13th 1984, approve item 8 of the General Purpose and Administration Report of the Committee Meeting of Monday, November 5th 1984, which established a Policy for the purpose of identifying Nodes or Clusters and reads as follows: "1. Report PD-185-84 be received; 2. The criteria within staff Report PD-185-84 and noted on attachment No.1 to said Report be adopted by Council; Council Minutes Notice of Motion 4IIt . Reports G.P.A. Report of November 19, 1984 Item /116 Snow Removal on Sidewalks in Urban Areas . - 5 - November 26, 1984 3. A copy of the said criteria, along with staff report PD-185-84 be forwarded to the Region of Durham for their information and records in consideration of the Town of Newcastle's request of the Region to review the Official Plan sections on Clusters in rural and open space areas." AND WHEREAS the Planning Committee of the Regional Municipality of Durham at their meeting of Tuesday, November 13th 1984, considered a request from the Town of Newcastle to amend the Region's policy on nodes and clusters, and by resolution declined to recommend a change in the Region's policy; THEREFORE be it resolved that the Town of Newcastle rescind the resolution which approved of the establishing of a Nodes or Clusters policy as detailed in Planning Report PD-185-84 and adopted by Council as item 8 of the Report of the General Purpose and Administration Committee meeting of November 5th 1984, and receive the subject report for information only. "CARRIED AS AMENDED" Resolution #C-738-84 Moved by Councillor Hamre, seconded by Councillor Taylor THAT a letter be sent to the three Business Improvement Area Boards of Management and the Management of the Bowmanville Mall asking for their continued co-operation and assistance in keeping the sidewalks clear for the benefit of all shoppers but in particular for the benefit of the Town's senior citizens. "CARRIED" Council Mintues .New Year's Levee .Citizen of the Year Award . - 6 - November 26, 1984 Resolution #C-739-84 Moved by Councillor Taylor, seconded by Councillor Hubbard THAT the recommendations in Mayor's Report 5-84 be endorsed; and 1. That Council support the holding of a Levee on New Year's Day, January 1st 1985; and 2. That arrangement for the Levee be made by a Committee which would consist of the Mayor and senior staff of the Town; and 3. That this Committee would have power to add members to it if necessary. That the recognition of the Citizen of the Year Award recipients be held at an event to take place on Friday, December 14th 1984, at 7:30 p.m. at the Lions Centre in Bowmanville; and 2. That those persons selected will have their names, together with a brief history of their contributions, disclosed on December 14th 1984; and 3. That all of those persons nominated for an award will be sent a letter of congratulations extending an invitation to attend the event on December 14th and ask them to bring family and friends; and 4. That all persons or organizations who submitted nominations be sent a letter of thanks and invited to attend this event; and 5. That gifts to the award winners will include a silver coin and a book entitled "Loyal She Remains", which book wi II be suitably inscribed for the occasion; and 5. "CARRIED" Recorded Vote Yea Nay Councillor Cowman Councillor Hubbard Councillor Hamre Councillor Hobbs Councillor Taylor Mayor Rickard Resolution #C-745-84 Moved by Councillor Cowman, seconded by Councillor Taylor THAT the Mayor's office inquire into the way in which appeals are dealt with, what the appeals are related to, what authority Assessment staff have with respect to the filing of appeals with the Ontario Municipal Board against the decisions handed down in favour of the taxpayers, and whether the Town has any authority or jurisdiction to inquire into the actions taken in regard to the tax appeal matters. Other Business Donation to the Ethiopian Famine Relief Fund Confirming By-law . - 9 - November 26, 1984 Resolution #C-745-84 Moved by Councillor Hubbard, seconded by Councillor Taylor THAT leave be granted to introduce the following by-law and that the said by-law be now read a first time: 84-138 being a by-law imposing special annual drainage rates upon land in respect of which money is borrowed under The Tile Drainage ACt, 1971. "CARRIED" Resolution #C-748-84 That the third and final reading of By-law 84-138 be approved.
