from Mr. J. David MacGregor, Solicitor, MacGregor and
Van Nest, requesting that the Town of Newcastle
authorizing the use of its Corporate Name by the young
offenders programme, which is applying for incorporation
as the "Town of Newcastle Community Service Order Programme",
be received;
AND THAT the request for permission to use the Corporate name

THAT WHEREAS the Provincial Subsidies to this Program
are not appearing to keep pace with present day costs;
AND WHEREAS the Library Board is facing some unusual
costs in 1984;
AND WHEREAS their proposed budget also includes
approximately Five Thousand Dollars ($5,ODO.00) for
a maintenance contract on the new heating unit, said
contract to protect the Municipality's initial
investment in the unit;
AND WHEREAS most of the costs in the proposed budget
are fixed costs;
.
THEREFORE BE IT RESOLVED THAT an additional $15,000.00
be granted in Library Board Funding making their 1984
increase, 10.6 percent over the 1983 budget, said
$15,000.00 to come out of contingency account
#7007-0298-X-9.

with Hydro relative to planting trees to replace those

taxpayer.

THAT Council thank Mrs. Oakes for her assistance in
providing a permanent drape for unveiling of plaques
which can be used in the future.

Councillor Woodyard presented a Notice of Motion

THAT WHEREAS on April 13th 1983, the Council of the
Corporation of the Town of Newcastle did, by Resolution #C-272-82
approve Item #2 of the Chairman's Report of the General
Purpose and Administration Committee Meeting of April 5, 1982,
respecting Pythbow Developments Limited proposed Shopping
Centre at the 401 Highway and Waverly Road;
AND WHEREAS Council Resolution #C-272-82 re-affirmed
Council's previous position opposing the proposed development
and authorized staff and the Town's Solicitor, pursuant to
Section 3 of General Purpose and Administration Resolution
#GPA-442-82 "to fil e an objection to said approval and
request the Minister of Municipal Affairs and Housing to
refer the subject amendment to the application to the
Ontario Municipal Board;"
AND WHEREAS following a review of the Bowmanville Improvement
Area (D.B.I.A. Consultant's Market Study and Analysis)
there appear to be conflicting findings that make the Study
somewhat less than conclusive;
AND WHEREAS the Regional Municipality of Durham have
agreed to provide the necessary services to Pythbow
Developments Limited Lands;
AND WHEREAS the servicing of the Pythbow lands would result
in a benefit to other developers and property owners in the
area;
AND WHEREAS in times of restraint it would be unwise for the
Council of the Town of Newcastle to retain legal counsel to
oppose this application for development because of the
significant costs that could result from such a Hearing;
THERE BE IT RESOLVED THAT the Council of the Town of
Newcastle reassess its position with respect to the
proposed Pythbow Developments Limited Shopping Centre and
rescind Council Resolution #C-272-82, and that staff and
the Town's Solicitor take no further action on this matter
or carry the Town's position to the Ontario Municipal Board.

I, Councillor Marie Hubbard, wish to move or
cause to be moved, a Notice of Motion, at a future
meeting of the Council of the Town of Newcastle:
Moved by Councillor Hubbard, seconded by Councillor Woodyard
WHEREAS the Bowmanville Mall received in 1979, all
approvals to proceed with the third phase expansion
programme, and to date, have not been successful in
expanding to provide a large department store; and
WHEREAS the Region of Durham has advised the Town of
Newcastle, through its Solicitor, that a development
agreement between Pythbow and the Regional Municipality
of Durham has now been executed and registered on title,
and the monies required pursuant to the terms of the
agreement to be paid on execution, have been received by
the Region; and
WHEREAS the

WHEREAS the Region of Durham has 20 million dollars invested
in water and sanitary sewerage projects in the Town of
Newcastle, and the Region has not realized a return on its

depreciation to homes on Hunt Street as a result of
inadequacies in the size of the pipes and in the pumping
station on Baseline Road; and
WHEREAS the Town of Newcastle gave favourable support to
the Region by resolution September 13, 1983 to use OHAP
funds to construct a sanitary sewer on Baseline Road in
order to assist development of East Woodbridge and at least
three other proposals and also facilitate development for
a Special Purpose Commercial area in that vicinity; and
WHEREAS the Market Impact Study on the effects of the
proposed Pythbow Mallon Bowmanville downtown core recommends
that unless provisions are made to realign merchandise for
the consumers to address the deficiencies specifically for
the 12-24 age group and if Phase III of the Bowmanville
Mall cannot be built now, the Mall is a necessity at the
present time; and
WHEREAS development in the Town of Newcastle has realized a
mere $77,062 in Lot Levies in 1983, a clear indication to
the taxpayers that progress in development is limited; and
WHEREAS assessment is of concern to a number of taxpayers,
Pythbow would realize approximately $250,000.00 or more in
assessment base to assist in the reduction of the ever
increasing burden of taxation in the Town of Newcastle;

RESCIND G.P.A. Resolution #948-83, and that Council
approve the request for rezoning to permit the Pythbow
Development to proceed.
