TOWN OF NEWCASTLE APRIL 5 1982 Minutes of a Special Meeting of Council held on Monday, April 5 1982 at 4:30 p.m. in Court Room #2 for the purpose of discussing a personnel matter. Present were: Mayor G. B. Rickard Councillor Diane Hamre Councillor Marie Hubbard Councillor Maurice Prout Councillor R. Bruce Taylor Councillor E. R. Woodyard Deputy Clerk, G. Gray Absent: Counci llor Ann Cowman Also Present: Chief Administrative Officer, Don Smith Resolution #C-255-82 Moved by Councillor Hamre, seconded by Councillor Hubbard THAT Item 1 of the Mayor's report on Delegation to Council meeting on Monday, March 29 1982 re "Adverse Publicity of Public Works Department" be approved and the report be received for consideration of Co unci 1 . "CARRIED" Resolution #C-256-82 Moved by Councillor Hubbard, seconded by Councillor Taylor THAT Item 2 be approved and the attached statement be released as a public statement. S TAT E MEN T As a result of numerous delegations to Council, the latest of which was at the meeting of Monday, March 29th, 1982, when the resignation of Council was demanded, Council feels it appropriate to issue a statement. Council appreciates that many residents of Newcastle have deep concerns relating to the resignations of the Director of Public Works and the Purchasing Agent. A difficult situation confronted Council when certain allegations were made by a former employee. Following a period of deliberations, a settlement was negotiated with the gentlemen who were represented throughout by legal counsel. The settlement has not been challenged by the gentlemen and Council has been assured that they are not involved in any way with the de 1 ega ti ons to Counci 1 . Notwithstanding the individual views of the Mayor and each Member of Council, Council speaks by resolution and the Corporation and every Member of Council are bound by its collective decision as expressed by the resolution. While some may question its decision, Council is satisfied that it has acted at all times according to law. The latest delegation has indicated that it has requested a Commission of Inquiry to be appointed by the Minister pursuant to Section 180 of The Municipal Act. Concerned citizens have the right to make such a request and Council will not stand in -the way of such a commission being appointed and will not take any position one way or the other to sway the decision of the Minister. It is regrettable that this most unfortunate situation ever arose and that it has preoccupied so much time and attention, but Counci 1 feels that there is nothi ng more that it can usefully add at this time.
