WHEREAS Cean Investments (Oshawa) Limited has entered into a Subdivision Agreement with The Corporation of the Town of Bowmanville for the development and subdivision of part of Burk's Plan dated December 7th, 1887 and October 4th, 1888; AND WHEREAS the development of the said lands includes parts of Burk Avenue, Townsley Street, First Street and Arthur Street, more particularly described in Schedule "A" attached hereto; AND WHEREAS the Town has agreed to make application under the provisions of the Registry Act to close the said parts of Burk Avenue, Townsley Street, First Street and Arthur Street; NOW THEREFORE BE IT RESOLVED as follows: 1. THAT the Corporation of the Town of Bowmanville make application to The County Judge pursuant to the provisions of The Registry Act, to close the said parts of Burk Avenue, Townsley Street, First Street and Arthur Street, according to the said Burk's Plans, more particularly described in Schedule "A", hereto. . . THAT the Mayor and Clerk be authorized to sign all necessary documents and take the required action in connection with the said application. 3. THAT in the event of the Plan of Subdivision submitted by Cean Investments (Osha.;a) Limited is ready for registration prior to the above mentioned streets being closed, then the Mayor and Clerk be and are hereby authorized and directed to sign the said Plan of Subdivision on behalf of the Town of Bowmanville as Owners of the said streets and to impress the Corporate Seal of the Town thereon. Schedule "A" - ALL AND SINGULAR that certain parcel or tract of land and premises situate, lying and being in the Town of Bowmanvill e, County of Durham, Province of Ontario, being composed of that part of Townsley Street lying to the East of Burk Avenue, and that part of Burk Avenue lying to the North of the production Westerly of the North limit of Lot 1, all according to C.C. Burk's Plan dated December 7th, 1887, made by J.H. Reid, P.L.S., as laid out on part of Lot 11, Concession 2, formerly Township of Darlington, now in the said Town of Bowmanville, and Townsley Street lying to the West of Arthur Street, and all those parts of Burk Avenue, Arthur Street and First Street lying to the South of the South limit of the Canadian Pacific Railway right-of- way, all according to C.C.
