TOWN OF NEWCASTLE Special Council Meeting Roll Call Change of Place of Meeting Report of Planning & Development Committee dated July 4 1978 By-Law No. 78-55 July 6, 1978 Minutes of a Special Meeting of Council held on Thursday, July 6, 1978 at 1:15 p.m. in the Committee Room of the Bell Building. Present were: Mayor G. B. Rickard Councillor Alfred Gray Councillor R. Bruce Taylor Councillor E. R. Woodyard Town Clerk, J. M. McIlroy Also Present: A. Guiler, Town Manager J. Dunham, Director of Public Works J. Ferguson, Deputy Director of Public Works L. Kristof, Director of Planning D.J.D. Sim, Town Solicitor Absent: Councillor D. W. Allin Councillor R. Dykstra Councillor J. W. Holliday Resolution IIC-78- 982 Moved by Con. Taylor, seconded by Con. Gray THAT the change of place of the meeting, which was originally called for Hampton, be approved as all members of Council had been advised. "CARRIED" Resolution Ilc- 7 8- 983 Moved by Con. Taylor, seconded by Con. Woodyard THAT the report of meeting of the Planning and Development Committee, dated July 4, 1978, be adopted. "CARRIED" Resolution Ilc-78- 984 Moved by Con. Taylor, seconded by Con. Gray THAT leave be granted to introduce By-Law No. 78-55, being a by-law to authorise the entering into a subdivisbn agreement with Claret Investments and Rexgate Holdings Ltd., (re Subdivision 18-T-76027) and that the said by-law be now read a first time. Gray By-Law No. 78-55 THAT the second r.eading of By-law No. 78-55 be approved as amended. "CARRIED" Resolu tion Ilc-78- 986 Moved by Con. Taylor, seconded by Con. Gray THAT By-Law No. 78-55 be amended by adding the words "which is annexed hereto as Schedule "A" to the first paragraph. "CARRIED" Resolution Ilc-78- 987 Moved by Con. Taylor, seconded by Con. Gray THAT the third reading of By-Law No. 78-55 be approved, as amended. "CARRIED" The Clerk was requested to note that Schedule "R" in the Agreement had been amended to delete the 1% additional charge for Administration Services in Subdivision AgreementB Nos. l8-T-76027 and l8-T-76048. Woodyard By-Law No. 78-56 THAT leave be granted to introduce By-Law No. 78-56, being a by-law to authorise the entering into a Subdivision Agreement with Claret Investments and Rexgate Holdings Ltd. (re Subdivision #18-T-76048) and that the said by-law be now read a first time. "CARRIED" Resolution #C-78-989 Moved by Con. Woodyard, seconded by Con. Gray THAT the second reading of By-Law No. 78-56 be approved as amended. "CARRIED" . . . Special Council Meeting - 3 - July 6, 1978 Resolution Ilc-78- 99.Q Moved by Con. Woodyard, seconded by Con. Taylor THAT Schedule "A" of By-Law No. 78-56 be amended to provide that Schedule "0" of Subdivision Agreement pertaining to Subdivision 18-T-76048 be amended by deleting the word "Newcastle" and substituting therefor the words "as provided in Schedule "Q" and that Schedule "p" of the same agreement be amended by inserting in paragraph 1. of the Schedule, the following "there shall be no reimbursement by the Municipality to the owner for improvements to the external roads". Gray, seconded by Con. Woodyard THAT the third reading of By-Law No. 78-56 be approved as amended. "CARRIED" Resolution Ilc-78- 993 Moved by Con. Taylor, seconded by Con. Gray By-Law No. 78-57 THAT leave be granted to introduce By-Law No. 78-57 being a by-law to authorise the entering into an agreement with Claret Investments and Rexgate Holdings Ltd., pertaining to Subdivision 18-T-76027 to provide for the posting of a letter of credit by the Developer in the event that the Mortagees do not sign the Subdivision Agreement as per By-Law No. 78-55 and that the said by-law be now read a first time. "CARRIED" Resolution #C-78-995 Moved by Con. Taylor, seconded by Con. Gray THAT the third reading of By-Law No. 78-57 be approved. "CARRIED" Resolution #C-78-996 Moved by Con. Taylor, seconded by Con. Woodyard By-Law No. 78-58 THAT leave be granted to introduce By-Law No. 78-58 being a By-law to authorise the entering an agreement with Claret Investment and Rexgate Holdings Ltd., pertaining to Subdivision l8-T-76048 to provide for the posting of a Letter of Credit by the Developer in the event that the Mortgagees do not sign the Subdivision Agreement as per By-Law No. 78-56 and that the said by-law be now read a first time. Gray THAT the Staging as set out in the drawing as attached to a copy of this Resolution in a file in the Town Clerk's Office be approved. "CARRIED" Resolution #C-78-l000 Moved by Con. Taylor, seconded by Con. Gray THAT leave be granted to introduce By-Law No. 78-59 being a By-law to confirm the proceedings of the Council of the Town of Newcastle at this meeting held on the 6th day of July, 1978 and that the said by-law be now read a first time.
