Council Minutes Council Minutes Mr. Denis Prue TOWN OF NEWCASTLE October 22 1979 Minutes of a regular meeting of Council held on October 22 1979 at 7 p.m. in Court Room #1. Present were: Mayor Garnet B. Rickard Councillor Keith Barr Councillor William Clarke Councillor Ann Cowman Councillor Ivan M. Hobbs Councillor Jasper W. DeGroot, Treasurer Resolution #C-1380-79 Moved by Councillor Barr, seconded by Councillor Clarke THAT the Minutes of the Council Meeting held on October 9 1979 be approved as read. "CARRIED" Mr. Denis Prue appeared before Council regarding re-zoning of his property (#ZA365). He was advised that the matter had been deferred to the next meeting of the Planning and Development Committee on November 8 1979. Mr. Doug Barber appeared before Council regarding the sale of Town property to Mr. John McEwen. He was advised that this matter had been deferred to the next meeting of the Planning and Development Committee on November 8 1979. Mr. Webb appeared before Council regarding Schickedanz Development as per Item #7 of the Planning and Development Committee report of October 15 1979. He requested that this item be deferred to the next meeting after November 8 1979. Santa Claus Parade Resolution #C-1382-79 Moved by Councillor Hobbs, seconded by Councillor Barr THAT the letter dated September 10 1979 from the Santa Claus Parade regarding the parade on November 17 1979 be received and the recommendation of the Town Manager that the necessary approvals be given be endorsed. "CARRIED" , Ontario Career Week Resolution #C-1383-79 Moved by Councillor Clarke, seconded by Councillor Barr THAT the letter dated September 1979 from the Secretariat for Social Development regarding Ontario Career Week be received and that the request therein approved and also that a proclamation be published on the Town Notice Board. "CARRIED" Resolution #C-1384-79 Moved by Councillor Clarke, seconded by Councillor Barr Poppy Tag Day and Armistice Parade THAT Council concur with the request of the Royal Canadian Legion, Bowmanville, to hold the annual Poppy Tag Day on the week of November 4 through 10 1979 and the annual Armistice Day Parade on Saturday, November 10 1979. "CARRIED" Resolution #C-1385-79 Moved by Councillor Hobbs, seconded by Councillor Holliday THAT the Town Clerk be authorized to make the necessary arrangements with the Royal Canadian Legion and ministerial associations with regard to the Remembrance Day Parade for 1979. Council Minutes Village of Burketon Regional Industrial Department Municipal Elections Act re Limitations on Election Expenses -3- October 22 1979 Resolution #C-1386-79 Moved by Councillor Cowman, seconded by Councillor Clarke WHEREAS the storm drainage (ditches and culverts) in the Village of Burketon is reported to be in a very poor state of repair. Site lines on the main North/South Road appear inadequate. The travelled portion of the main North/South Road appear to be from 15 to l7~ feet in width and the soft shoulder in need of grading to avoid up to a 4" drop in places from the pavement to the shoulder. The railway crossing, related drainage and warning signs appear below standards. THEREFORE be it resolved that the Director of Works report to Council (through Committee) what in his opinion is the state of repair of these items and the remedies necessary to upgrade these facilities to the standards of other hamlets in the Town of Newcastle and how best to accommodate this work within the works budget. "CARRIED" Resolution #C-1387-79 Moved by Councillor Cowman, seconded by Councillor Barr BE it resolved that Council ask for a report of the activities of the Regional Industrial Department and its relationship to the Town and the number of jobs they have been responsible for creating since January 1 1974, and also their plans for the immediate future for this Municipality. "CARRIED" Resolution #C-1388-79 Moved by Councillor Cowman, seconded by Councillor Hobbs WHEREAS the Municipal Elections Act 1977, Chapter 62, Section 121 provides that the Council of a Municipality may by by-law provide for a Limitation on Election Expenses; THEREFORE be it resolved that a by-law be prepared for Limitations on Election Expenditures by or on behalf of all candidates including those candidates for Mayor in a Municipal election and to require the disclosure by a candidate of all election contributions in excess of $100.00. The said by-law to make provision for a limit of no more than $2,000 be allowed to those candidates seeking regional seats, $1,500 for those seeking Council seats and $6,000 for those seeking the position of Mayor. 6 . v . "CARRIED" COilllcillor Holliday declared a possible conflict of interest on the foregoing matter and took no part in discussions or voting. Council Minutes No Parking Highway 401 - Wilmot Creek McGregor Drugs Sign Hydro Liaison Committee -9- October 22 1979 Resolution #C-14l3-79 Moved by Councillor Holliday, seconded by Councillor Prout THAT the resolution #W200-79 which requested the Ministry to provide some off-Highway parking is being acknowledged and fulfilled. We approve the Ministry of Transportation and Communications' endorsement of their recommendation in order that they may proceed in obtaining an Ontario Regulation to prohibit parking on 401 in the area of Wilmot Creek conditional on The Ministry of Natural Resources providing suitable parking on Cobbledick Road south of 401 and north of the Railroad which is in the process of being arranged. Council Minutes In Camera Meeting of the Planning and Development Conunittee By-Law No. 79-110 -10- October 22 1979 Resolution #C-1417-79 Moved by Councillor Cowman, seconded by Councillor Hobbs WHEREAS Resolution #PD 442-79 provided for a Special "in camera" meeting of the Planning and Development Conunittee to be called to consider the proposed District Plan of the Village of Newcastle, and WHEREAS the meeting was held on October 15 1979, and WHEREAS no positive action was taken at the said meeting, THEREFOillbe it resolved that the minutes of the Special Meeting of the Planning and Development Conunittee held on October 15 1979 be received for information. Council Minutes Pedwell Expropriation North/South Arterial Road -14- October 22 1979 Resolution #C-1438-79 Moved by Councillor Prout, seconded by Councillor Holliday WHEREAS the Corporation of the Town of Newcastle by By-Law 79-87 has expropriated a portion of the lands owned by Maurice Harold Pedwell and Olive Marie Pedwell being part of Lot 30, Concession 2, Geographic Township of Clarke and more particularly being described as Part 3, Plan 10R843; and WHEREAS and appraisal of the aforementioned property has been prepared by the Regional Municipality of Durham, Land Purchase Division; and WHEREAS the property has been appraised at a market value of $1,200.00; BE IT THEREFORE RESOLVED THAT; THE CORPORATION OF THE TOWN OF NEWCASTLE OFFER AS COMPENSATION FOR THE LANDS EXPROPRIATED from Maurice Harold Pedwell and Olive Marie Pedwell the sum of $1,200.00. "CARRIED" Resolution #C-1439-79 Moved by Councillor Holliday, seconded by Councillor Hobbs BE IT RESOLVED that the Council of the Town of Newcastle respond to the Regional Municipality of Durham's request for the Town's direction regarding the location of eastern Bowmanville interchange and that the Town of Newcastle requests the Regional ~funicipality of Durham approve the location of the future North/South arterial road and Highway No. 401 interchange be as shown on Alternative No.4 (Training School Road or Lamb's Road) in the eastern part of Bowmanville and direct the Regional Planning and Development Department to bring forward the suitable O.P.A. to the next Regional Council meeting for their approval. Council Minutes Bus Shelter King and Division Streets Street Lighting Time of Meeting Adjournment -15- October 22 1979 Resolution #C-1440-79 Moved by Councillor Prout, seconded by Councillor Holliday THAT the matter of the bus shelter at King and Division Streets be referred to the Town Manager to report to the next Council Meeting as to why the shelter is not in place.
