That the resolution from the Township of Puslinch be supported with the following wording added as the next to last operative clause to the resolution: And further, where the licensed aggregate deposit is located in such a manner that the predominant access to the site is through an adjoining municipality that the tonnage fees collected be split in such a manner as to reflect the added cost of road maintenance to the adjoining municipality. BACKGROUND AND COMMENT: In 1979 the then Government brought forward Bill 127 which was an Act to replace the Pits and Quarries Control Act. There was much discussion on this legislation from both municipalities and the aggregate industries. Part of the proposed legislation was to provide tonnage fees to the municipality to compensate such municipalities for added use of roads and depreciation allowance to the aggregate material removed. The suggestions brought forward in the resolution as sponsored by the Township of Puslinch reflect the concept of a levy paid by the aggregate producer to the host municipality. In most instances this would be a fair Ul�ala, ADMIN. 68 - 85 -2- reflection of the access that must be provided to such aggregate deposits. However, in certain circumstances such a levy paid to the host municipality would not fairly reflect the service level that must be provided by an adjoining municipality. In the case of the Town of Newcastle there are numerous licensed gravel deposits that border our municipality to the north. Predominantly access to southern markets is gained through the Town of Newcastle and the Regional road system. The proposed addition to the Puslinch resolution would provide for this circumstance. The actual apportionment of the fees could be done through the licencing procedure. With the proposed addition the resolution would more accurately reflect the interests of the Corporation of the Town of Newcastle. IUWIV tItV UP I'D 1.1 N(.8 t11L 11 _ X11 BY : �SK�' t> v-f� DATE: October 2, 1985 _MOVED 1 SECONIIED bY: THAT: HIiSULLI'I'LON WHEREAS the need for a new Aggregates Act is required in the Province of Ontario; more particularly, the need for an aggregate extraction levy on granular extraction in the Province of Ontario; AND WHEREAS: Aggregate producers in the Province of Ontario extract large ". amounts of gravel, .stone, sand and other materials; AND WHEREAS: Within the Municipality such extraction takes place and there is only minimal taxation revenue from Lite operation; and the said operations, in most instances, require only non -taxable machinery to remove the aggregates; AND WHEREAS: Municipalities in the Province of Ontario feel that when a gravel '. pit is allowed to operate in their area and approval is given by the Ministry of Natural Resources, a levy .should be payable to the Municipality, collectively, the aggregate producers aresupportive of such a policy; AND WHEREAS: The responsibilities of the Municipalities are compounded when such. an industry is allowed to locate in their area; the number of gravel trucks, the environmental concerns and the protection problems associated with such an industry are more numerous and as such an extraction levy is deserving; NOW THEREFORE the Council in and for the Township of Puslinch, County of Wellington does hereby humbly petition the Honourable Vince Kerrie, Minister of Natural Resources and the Ontario Government to immediately forthwith take steps to enact a new Aggregates Act wherein a municipal levy on aggregate extractions throughout the municipalities of Ontario may be applied, the, said levy to be related to the annual tonnage of material so extracted; AND FURTHER: The recommended and fair levy being four cents ($.04) per tonne so extracted shall be applied to all extractions in all municipalities; AND FURTHER: The financial sum so calculated ($.04) per tonne shall be in direct relationship to the annual tonnage report to the Provincial Treasurer under the provisions of the new Aggregates Act; AND FURTHER: _. 11 The above said levy shall apply to all pits and quarries within any 1 ' municipality and shall equally apply to all municipal, wayside, temporary or Ai established pits and quarries; {{! i AND FURTHER: 9 The above said specific monetary levy allocations shall be dis- tributed via a Municipal Council resolution in any given municipality; 1i ,11 llj AND FURTHER: The monies derived from this levy shall in no instance benefit the aggregate producers but shall be used for the scle benefit of the residents and ratepayers of any given municipality; AND FURTHER: To insure this direct benefit, the financial transaction shall take place directly between the aggregate producer and the municipality; AND FURTHER: The monies derived from this levy shall in no way reduce or jeopardize the normal allocation of subsidy monies received from the Ministry of Transportation and Communications; kl:SOUH OS (cunt'd) Page 2 AND FURTHER: 'Chat this resolution be circulated to: - Like Honourable David Peterson, Premier of Ontario - a]1 municipal.itio., in the Province of Ontario; - the Iluuuurablu Vine.• 6errio, M.iuistur of Natural Resuurces; - Rick Ferraro, MPP, Wellington South; - Elie Aggregate Producers Association; - the County of Wellington; and, - the Association of Municipalities of Ontario for their support and endorsement of this resolution and that the Premier of Ontario, the Minister of Natural Resources, the local MPP's, the Association of Meed cipali ties of Ontario and this office be notified of their support.
